Im writing to you as your organization can get the word out to people and their communities as a warning of the illegal and scamming tactics of the company owned by Paul Draher, Boot-It.




 




I am a single mother with a 17 year old daughter who is graduating high school this year. I live with her along with my fianc and his 4 yr old daughter.  I hold a dual bachelors degree in Business Management and Business Administration.  I own my home in a small, gated community in the Southern Highlands area known as Ansedonia.  Ansedonia is a community that has no signs indicating that it is a no parking community.  However, unless youre a long time resident or have been immobilized or towed, you would never know.  There are not any no-parking signs on the street or when you come in to the community except for the small cul-de-sacs.  This leads you to believe that parking is allowed  everywhere else. 




 




On August 17, 2009, my daughter had parked my truck on the street on the side of my house in between two signs that said, No parking beyond this point.  Believing that since the truck wasnt beyond either of these signs; my daughter thought it was ok to park there.  I was on my way home from work when I received a call from my fianc telling me that when he got home, he had seen that there were boots clamped on two of the four tires on my truck.  One of the boots was clamped on to the tire and not on to the rim almost puncturing my tire.  I told my fianc to release air from the tire so that we could take the boot off as I was afraid my tire was going to blow. 




 




Shortly thereafter I arrived home and began to help my fianc. As we were about half way done of taking the tire off to release the air, a white, unmarked, Nissan Titan truck drove up and two guys by the name of Doug and Paul jumped out and said that they could take off the boots for $200 cash plus another $75 for a tampering fee. I told them of how idiotic of them placing the boot to where its clamped on the tire and not the rim and of how it was going to cost them $300 to replace my tire had it blown.  I also told them that how could they put immobilize my truck if number one, Im not parked behind the Do not park beyond this point signs and Ive never had a warning or violation sticker.  Doug, who claimed to be the operations manager, proceeded to tell me that they had indeed ticketed my vehicle. 




 




My truck has NEVER been ticketed by Boot-It or anyone else for that matter. I demanded for them to provide me proof and they insisted they didnt have to.  I then demanded to talk to the owner and thats when the short guy with glasses, Paul, spoke up and said he was the owner.  I then told him the same demanding to show proof and that I was not going to pay anything until he did.  I then called LVMPD and they told me that since it was on private property, in this case a community within a homeowners association, that it was a civil matter.  We argued back and forth for about ten minutes till he said that it was NOT their policy nor did they HAVE to have had given a violation, warning, or any kind of ticket before having to immobilize a vehicle. 




 




I then said now that they know they had no proof of ever given a warning on my truck that they all of a sudden just changed company policy?  I still refused to pay as they were clearly lying.  Paul then lifted up his shirt, touched his gun, which was a Glock 40 I believe, and pointed towards the taser that Doug had and said that if we didnt have $200 cash in the next 15 minutes that my vehicle would be towed.  My teenage daughter was standing right there!  How could they be such cowards and to indirectly threaten my safety in front of my daughter?! 




 




I was so upset knowing that they had lied about giving me a warning and then all of a sudden after they knew they couldnt provide proof, they all of a sudden changed policy.  I couldnt believe that this was happening. I felt like my truck was being held for ransom and if I didnt pay, mine and my daughters safety was in danger.  So after being so terrified, I left to the bank and withdrew $200 consisting of ten, $20 bills.




 




At that time there was construction going on the street of Cactus, which is right next to my community.  I wanted so badly to give these liars a dose of their own medicine so I drove up to one of the port-a-potties and grabbed a plastic bag I had in my car.  I used the bag as a glove to cover my hand, held the bills at one end and dunked the currency into the human urine and feces.  I then pulled the bag over covering the money, got back in to my car, and drove back to my house.  I then pulled in to my garage, got out, dropped the money on to the ground out of the bag, grabbed the tiny area at the other end that was not soaked with urine and feces, walked up to Paul and said, Oh sorry.  I accidentally dropped the money into a puddle of water as I was pulling it from the ATM.  He said it was alright until he realized from the gagging smell and began yelling at me and demanding hand sanitizer or a towel.  I replied with a smile, You got your money.  What are you going to do?  Call the cops?   They wont do anything. Its a civil matter.  I then told my fianc to take care of them and to get the receipt as I didnt want to deal with them anymore.




 




My fianc then moved my truck to our driveway.  The next day we woke up only to find my truck gone.  I was in shock.  I called LVMPD thinking it had been stolen.  LVMPD told me that it had been towed by Silver State Towing.  I then proceeded to call Silver State Towing and spoke with a male who told me he had received a call from Boot-It to have it towed.  I so was livid I could barely speak.  I then called the management company of my association and explained the situation to a supervisor.  Because it was an illegal tow, the management company then called Silver State who told them to bring back my vehicle for free. Silver State then called me and asked me where I would like my truck.  I said, Right back where you took it from, my driveway!  Nice try with that one Paul.




 




Nonetheless, they essentially stole $200 from me and my family since I didnt know I had to have had been warned with a 48 hour notice that I was in violation.  Since then I have come to find out the truth and have kept my eye out for these extortionists and tried to warn as many neighbors as I can hoping I can keep this from this form of extortion happening to anyone else. Many of my neighbors including myself have made several complaints with our association, CAMCO, which has only resulted in having fallen on deaf ears. 




 




I recently just two weeks ago seen two of my neighbors cars immobilized and I immediately stopped my neighbors from paying the $200 telling them that unless Doug and Paul could produce pictures of them having had given them a the 48 hour notice, that they werent following proper procedure.   The boots on both of those cars were taken off for free.




 




Another incident that just happened a few nights ago on the 26th of May of 2010 was with some other neighbors.  They were sitting outside their house relaxing when the unmarked, white Nissan Titan drove up as they had their car parked next to their house.  The neighbors asked if they could help Doug as they didnt know why he was there or who he was.  Doug then told them that they needed to move their car or he was going to boot it.  They told them they would be more than happy to move the car and when the owner of the car ran in to the house to get the keys, Doug got out and put a boot on the vehicle before the owner was able to return. Oh my goodness, are you serious!?  You distract and trick someone in to making them believe that youre being nice only to actually be bold-face lying and trick them?  Does that really make you feel like a great person inside? The neighbors also refused to pay at first until they were threatened and intimidated by the taser gun that Doug wears in a holster, by lifting his shirt and touching it.  After they felt their safety threatened and their car being towed, they paid the $200. 




 




A couple nights after that there was a next door neighbor of mine that had parked her Suburban in the street, which was right across from my house. I went outside to warn the neighbor when nearing the vehicle, I seen the FIRST EVER violation warning from Boot-It.  I guarantee you that this was only because it was right in front of my house. All the other incidents were in other areas of the community out of sight from my home.




 




The most recent incidents I know of were this past Memorial Day Weekend on Saturday, May 29, 2010.  My fianc called me to let me know that when he drove home and entered the community, he seen Doug from Boot-It and his Nissan truck, a tow truck, and LVMPD.  My fianc had arrived right when LVMPD was leaving.  Later on that night when I spoke with the neighbor, he stated that he was immobilized by Doug and was threatened to either pay the $200 or face the tow truck.  The neighbor refused to pay and called LVMPD while Doug called a tow truck.  Long story short, Doug ended up taking a $20 bribe from the neighbor to take the boot off.  I thought that was hilarious that Pauls trusted Director of Operations took a measly $20 bribe.  Im glad to hear that Paul is getting more doses of his own medicine.




 




The second incident that night was right by the entrance to the community.  Doug from Boot-It was there as well as the same tow truck again.  I arrived and suggested to the neighbors that if it were me, I would call LVMPD to make sure that Boot-It was following procedures and most importantly, the law. I began recording video on my phone while the neighbors were on the phone with LVMPD.  Not even 5 minutes later, Doug took off the boot without saying a word to the neighbors and left.  Wow, so isnt that more evidence that the law and proper procedures werent and still arent being followed?




 




What kind of a scam is this?  I feel like I live in the ghetto in Baltimore, Maryland and that I have to constantly watch my back because someone is likely to steal something of mine and then try to sell back to me.  I can never have friends or family over to visit without the fear of the same thing happening.  This company and especially its owner, Paul, are nothing but scamming, heartless, illegal, hustlers.




 




Boot-It still has yet to provide any picture of proof that they had given the proper 48hr notice to me or several others of my neighbors that were also victimized and taken advantage. Oh except for that Suburban truck that was parked right in front of my house.




 




I want to warn EVERYONE, HOAs, board members, associations, neighborhoods, the entire Vegas valley if not more, of this organization that scams and hustles people by intimidation, weapons, extortion, and bold-face lies.  Do not hire this company for parking enforcement in your community or neighborhood.  You could possibly put your association or management company open for a potential lawsuit for hiring a company that performs illegal practices, lies to people, cant provide proof, and still allows it to happen.  As member in good standing in community, I certainly hope someone that has had this done to them in my neighborhood, doesnt sue my community for the practices that have been allowed and continue to be allowed to happen.
