I quit the company and three days later the company notified DAC reporting a positive on a drug test. In my opinion, I donot feel that the company had a right to report anything since I quit. I have been out of work for 3.5 months. Driving is what I do for a living, or did do. I'm unable to find any one to hire me because of this report. Please Help.
What gives this (DAC) the right to take away my rights to pursue a way to make a living, and pursue happiness???
Would DAC and or CalArk be responsible if I blew my brains out?

Cal-Ark had to file your drug screen failure

It is a matter of federal law, The company you are working MUST file the result of the drug screen. The fact that they filed it with DAC is that there is a place on the /DAC report that specifically asks if the employee ever failed a drug screen while working for the company. Just because it took 2 or 3 days to get the results back failed the test doesn't mean that you were not employed when you failed. You failed the test as soon as you filled the cup... then MISREPRESENTED YOURSELF to the next company you were going to.
I worked for Cal-Ark, and the worst thing they ever did to me was keep me in the Laredo terminal for 4 days...I guess you're stuck working for the .23/mile small trash hauling company that the DOT loves to see cross the scales...JUST SAY NO TO DRUGS!

Sir. If you didnt take the drugs you wouldnt have had to worry about it. I worked for Calark for 3 years and they never put anyhing bad on my report. You should be more careful about what you take out here. Ifyou do drugs you shouldnt drive a truck. You give the rest of us good drivers a bad name.

I'm not sure I understand your complaint. Is it that they FALSELY report the drug test OR did you fail and quit before they fired you? If the accusation is false, you need to file with DAC and sue CAL ARK.
If you failed the test or refused to take it and quit because of it, then THANK YOU CAL ARK for keeping a CDL driver off the road that is using drug and endangering innocent lives.
If you failed the test...... Do all of us a favor and find a NON driving job you will get no sympathy from me.
