Complaint: Misrepresentation by Cana Rock, Punta Cana, Dominican Republic

Recently I flew to Punta Cana, Dominican Republic for one day to view a home for sale and met with the Agent Andy Schlenker of Trust Realty. After viewing property It was not for me. Mr. Schlenker said he had a new property in the construction phase located on-site of the Hard Rock Hotel & Casino, Punta Cana, Dominican Republic. We stopped at the Cana Rock public relations office where I met the staff and obtained a color brochure of the project. It was almost dark and raining but I saw the property. Mr. Schlenker convinced me Cana Rock condos would be an excellent purchase bearing the brand name of Hard Rock Hotel & Casino. I too immediately thought Cana Rock indeed would be known world wide because of the brand. I took photos and I informed Mr. Schlenker I would present what he and the sales staff had told me about Cana Rock to my wife upon arriving home in the US. The next day I presented the project to my wife and said I thought it was an excellent buy being that it belonged to the Hard Rock Hotel & Casino of Hard Rock Hotels & Casinos fame. I contacted Mr. Schlenker to immediately send us a plan showing available units for sale. He sent the plan with both sold and available condo units. Only a few had be sold. We asked many questions of Mr. Schlenker. Finally, after our questions were rapidly answered we made our offer to buy, at the advertised price. He said he would have to contact the Cana Rock sales department and make certain our selected unit was available. He immediately got backed to us and said it was available and he would get us a contract to buy along with the international banking SWIFT code for us to transfer our downpayment. We received the document the next AM and were en route to our bank to transfer the downpayment funds when I received an email from Mr. Schlenker saying he was sorry but the unit we selected had been sold. How could that be we asked and he said he did not know anything other than the unit had been sold. After a couple of phone calls to Mr. Schlenker he said he wanted nothing more to do with this “problem”, i.e., us. I went to the Cana Rock website and contacted the Project Manager, Ms. Maria Perez and emailed her our questions as to how this happened. She said another party wanted the same apartment, the one we offered to purchase. Strange since there were only less than 10 marked as being sold and over one hundred available condos available for purchase. Ms. Perez said she took a down payment from the other party that wanted the same apartment that we had already offered to buy. We re iterated to Ms. Perez that the sale was already in progress and we were on our way to the bank for funds transfer. This information fell on deaf ears. She offered us another unit.
We believe Ms. Maria Perez’s actions were unethical. We also believe Mr. Schlenker did not represent us properly, did not know what he was doing and let our apartment be sold right out from under us. Furthermore, Mr. Schlenker and those in the public relations office of Cana Rock misrepresented the Cana Rock Condos project as being owned by Hard Rock Hotel & Casino, Punta Cana, Dominican Republic and being a part of the Hard Rock Hotels & Casinos International, Orlando, Florida, USA. Why would one think otherwise when this project is located after the security gate and on the property of the Hard Rock Hotel & Casino, Punta Cana. This was a gross misrepresentation of the truth by both Mr. Schlenker of Trust Realty, Punta Cana and by the public relations personnel, including Ms. Maria Perez, Project Manager of Cana Rock, Punta Cana.

When Ms. Maria Perez, project manager of Cana Rock reiterated there ‘was nothing she could do to restore our purchase-in-progress’ I contacted the CEO of Hard Rock Hotels & Casinos in Orlando, FL, USA. He was emphatic in saying that Cana Rock was not in any way affiliated with Hard Rock Hotels & Casinos International and that he would have his legal department investigate the matter. I sincerely hope he does. Our main reason for buying in Cana Rock was the fact it was related to us that it was owned by Hard Rock Hotel & Casinos and affiliated with the international brand.

In conclusion, my wife & I want to share our experience with Cana Rock. I would do not recommend the Cana Rock project, located on-site of the Hard Rock Hotel & Casino, Punta Cana, Dominican Republic. We believe we were duped, lied to by an unethical group of people and if they did that to us (my wife is a Dominican citizen) they could very well do it to anyone, particularly non Dominican Citizens, who have little legal rights in that country.
