Camco sent a letter stating that I owed a credit card debt from 1982. In 1982 I did not even have a credit card.

Their demand was for $828.73, their "affadavit" stated that the original balance was for $470.37. When I called them to contest the collection, they stated that they would settle for $207.00??!!

What a scam!!! I'm going to send them a cease and desist letter, and I'll keep this forum posted as to the results.

First, it's irresponsible to say the SOL is 7 years or 4 years etc. Unless you know what state the contract was filed under then you don't know. This is dangerous advice to give. For example a contract is good for 15 years in Ohio!!!

Secondly, I know CAMCO is famous for bad collection practices and they should be punished as such. However, ANYONE who gets a letter from CAMCO or another debt purchaser - who honestly NEVER had a valid credit card or an account, should be concerned.

Debt buyers do not just pick you at random. They purchased what they believed to be a valid account IN YOUR NAME. If you never had an account then you should be VERY CONCERNED, because someone opened and account at some point in your name.

Third and finally, use some common sense. I've heard many instances of people who claim never to have had an account with Citibank, but upon further research the account was originally opened with another bank and then it was purchased by Citibank or the original bank merged and the name changed. Sometimes there are explanations for these things.

Go for the throat

The SOL is how long they have to take you to court. It isn't seven years, it is in most states, three to four years.

If they feel they have a true case, tell them to take you to court.

The ticker can not be reset, PERIOD!!

You can make all the inquiries you want, it cannot be reset unless you make a payment.

That is why they will say you made a payment before the SOL ran out.

They got your phone number from you credit report. You should order you credit report under the purpose for fraudlent activity occuring against you and when you recieve it you will find them in the inquiry section, more than likly twice sio they stand out.

This section is only for situations that you applied for credit or some other offer you responded to.

When you confirm this, you can have it removed by informing the credit reporting agency that they are fraudently reporting out dated, disputed or not, debt.

They may get a little stupid on you, but by law they have to remove it; don't give up until they do. If they do, report them to the FTC as well.

FTC Contacted me about sCAMCO's tacticts...

I recieved a phone call today from a Paralegal working for the FTC, asking questions about the tactics and proceedures of sCAMCO. They are assisting in putting together a case with different state's Atty. Gens. I was only too willing to cooperate.

It seems that the Cease and Desist letter that I copied to the FTC had a desireable effect.

There is talk about the FTC again taking cCAMCO to task for their tactics. Bring it on!!

getting even, 7 years is the limit

7 years is the limit, but if you agree to this debt or ask for any info about debt, a statement etc, account may become active again starting the counter all over again. Check with your state laws on your rights. I would like to put the phone on hold or say the following. This call is being recorded for my records. please state your company name, your name and emplyee id number they usually hang up works every time.

The SOL for ALL debts in the U.S. is a maximum 7 years. I California it is 4 years. They have no right to collect and cannot do anything if you do not pay. When they call, just hang up on them. Do not get into fights, just ignor them. When they call I make a game of it, I do my best to get them pissed off..

It makes me laugh everytime they call...

sent cease & desist

I sent a cease and desist letter, cc'd IL AG, USPS Inspector, MT AG, FTC, and the big 3 credit bureaus.

I've been called every kind of worthless flake you can imagine. If I could truly remember having a credit card in 1982, or if they could prove it, it would be a different story.

I wish I were better versed in the legal aspects of old debt collection. They insist that the SOL does not apply to old debts. Is this true?

Can they back up any threats, like going to the VA, or SS, and besmirch me to them?

Also, how did they get an unlisted and unpublished phone number?

If anyone could help with these questions, I would certainly appreciate it.
