Carroll Construction Company Fraudulent Billing Winchester Virginia

I met with Andy the owner to purchase asphalt millings. He showed me two piles. One was "clean/screened" and he said there was 50-75 tons and would be $14/ton. One was dirty (had large chuncks of material in it) and he said there was 150 tons and it was $8/ton. I said I would take all of it. He said his drivers were $75/hr. 

We had two drivers start at 7am on July 5th delivering the millings. They worked from 7am and their last drop was approximately 3pm. We had 21 loads delivered total. The trucks were small and they did not use the drop axle while hauling, so only two axles were in use while hauling. This means there were not loaded to capasity. At the end of the day, the drivers never came back with weight tickets or even let us know they were finished.

No clean millings were delivered. I text Andy and told him to let me know when they were bringing the rest. He was supposed to talk to the guys and let me know. He never gave me a second delivery date. We ended up just using the millings they brought and I asked for a bill. I actually asked for a bill for almost 16 days. He kept making excuses why he could not get me a total. Finally, he sent me a bill for almost $6,000!!! I was being charged for 300 tons of dirty millings, 90 tons of clean, and 26 hours of hauling!!! 

Luckily, I have all of our texts, we have pictures of the trucks pulling in without the extra axles down, and piles of the millings. I also have a specialist come out and have a written statement of how many millings are out there. I offered Carroll Construction payment for what I had ordered, plus the hauling, but they declined and wanted the $6,000. I told them to sue me so I can get all of this on record.

I've already filed complaints with DOT, FMCSA, the State Police, and now I'm finding anyone else who will listen. I have asked around and this company has a horrible reputation within our community. Please beware - they are liars and cheats. I'm sure this will be litigated in the Frederick County Virginia Court System. Please check the cases so you can see what has been presented at trial.
