Order place on 12/8, money electronically taken out of my account on 12/10 for 189.00. I have not rec'd tracking number, which is normally done the day they take their money. I called, and checked web site. both state they are unable to process orders at this time. I found the FDA warning letter on line.
CD2U stated they had stock and order would be processed. Web site states they are not processing at this time. Local number has been disconnected.
I will contact my back to file a fraud complaint on Monday.
Looks like several have had this same issue.

For any customers of CD2U / Chavez, Inc - you may visit any of their websites for instructions on how to receive a refund for products ordered, but not shipped.

On December 9, 2009 the ATF (Bureau of Alcohol, Tobacco, and Firearms) raided the company and seized all their product, all their money, all their computers, and all their records making it impossible for the company to even contact customers to inform them of what happened. The ATF has given no explanation and has not filed any charges, however the company has been effectively shut down for the time being due to circumstances beyond their control.

I mailed a letter like the web site said. In fact I printed out the last invoice that they sent me and it had everything listed on it. I requested a refund on 12.27/09. So now lets see if they will refund our money.
If anyone has actually rec'd a refund from them, please update your complaint. I would like to see how long it is going to take to get our money.

I am in the same boat. I checked the ATF web site. no information there. Only thing I know to do I have done and would recommend that everyone else do it. File a complaint with the BBB and Attorney General in that state.
ATF is part of the federal government. Seems this operation was not filing excise tax or cigarettes were not tax stamped as should have been. I am not familiar with the law in Kentucky but I am not sure where he was purchasing his smokes from.
Back taxes could be owed against products purchased from him. I am not sure where to turn at this point.
I will in the future be more careful to use a company that pays excise tax and products that are stamped correctly. It may cost more, but it might be safer.
I also need my money refunded, as I have been unemployed for since April and my budget can't take a hit like this.

We really need to come up with a solution! Why was he raided? What are we supposed to do?

!!!!!just got off the phone with Mr. Chavez.....502-614-7029, seems the ATF raided him on 12.10 and has frozen his assets. He will not be refunding any money at this time. Said to call the bank and have the bank refund, the banks won't do this as his assets have been frozen.
He indicated that his hands are tied he is sorry for this problem.
What a lot of bull......Not sure which way to turn now.

Okay just talked to the bank, they are not able to help, since it is a business that I have done business with. They recommended that I file a claim with the Attorney General in the state. They claim this is a civil matter, and not bank fraud.
I have filed a complaint with the Better Business B. in Louisville as well. I am really disappointed that I could not get Bank of America to do anything. If everyone is like me, I am trying to save money, since being unemployed.
I just do not understand how this business could just shut it's doors and not ship what is paid for. I guess that is why they stopped taking credit cards a few years ago.
