Sales agent and self-described manager/Owner that I was dealing with is named Patrick McClafferty. He has never formally given his last name and is not listed on his business card. On February 7, I spoke to Patrick about a 2008 Audi TT. I signed a contract and gave a down payment of $1500 with a promise to pay $500 within the course of two months. I drove the car for one week and was contacted by a lender Alexandria from Sierra Auto Finance LLC. Alexandria asked if I was happy with vehicle and I told her that I was,but the tail light connector burned out one day after possessing the car and the hood latch was completely broken so there was no access to the engine based on the inspection received from the Criswell Audit dealership in Annapolis, MD.

 

She asked how much did I put down and I told her $1500 with the promise to pay $500 within two months. She said "that is an illegal practice and you are not allowed to defer payments in the State of Virginia". That ended our conversation. The dealership called a couple of hours later to say that there was a representative 20 minutes away from my home that would be repossessing the vehicle. He said that the lender would not be financing my loan and that it was my fault because I told them that there were problems with the vehicle. He sounded threatening and said on several occasions that he was on my side, but I signed a contract and he wants his $19,000.

 

I then explained that she indicated that Chase Auto Group was involved in illegal practice by accepting deferred payments to which he replied, "If you told her you only paid $1.500 then you were mistaken." I asked for my refund and he indicated that I was stuck in the contract. He also said that I should keep insurance the car because the car belongs to me. The next day I tried to contact him and I was told he was very busy with other customers. I became frustrated and once again asked for my down payment to be returned.

 

The next day which was a Friday I had a relative contact Patrick since it seemed as though he was avoiding my calls. He indicated that the car was being financed through Chase Auto Group and that I could come in on Monday to sign the paperwork. The relative indicated that there was no paperwork stating that an additional $500 was to be paid in two months and asked for a copy of it. He said that I should have had a copy and it doesn't matter if I do because he does.

 

He said that he has lawyers that look after all of his contracts and after 25 years he does not have legal issues. He also indicated that when I called him the day before that I sounded threatening when I said I wanted my money back and he doesn't respond well to threats. He said that I could not come in earlier than Monday because he was going out of town, but I should call him Monday, February 24 around 12:00 to make arrangements to sign paperwork and pick up the car. On Monday, Patrick was still very busy with customers and I was kept on hold for at least 48 minutes.

 

He picked up the phone to say he had an emergency and would not be able to assist me with closing the deal. He said he would call me on Tuesday. On Tuesday when I called, I was on hold for about 20 minutes and when he picked up he said he was swamped and hadn't had a chance to eat and would call me back. I have not received a phone call from Patrick and I do not believe as he indicated that I am stuck in this contract. His contract in bold states that if financing falls through that I am entitled to either find another lender OR gain my down payment. They clearly do not understand their own contracts.
