I recently had, well am having, a bad experience with Cingular. I have been trying to help my lil sis out with Capital One and Cingular as Cingular is charging her account for someone else's cell phone. Capital one states that this is not fraud, because it is a monthly charge. Cingular would not give her any information about the account number printed on her bank statement that the funds are being applied because she is not on the Cingular account. Cingular has drafted over $900 from her account. To make matters worse, overdraft fees, NSF fees have exceeded the the $2000 range. I finally tried to talk to people and got no response....

**Not so Customer Service phone conversation.**

After filing dispute after dispute with Capital One (What can we take from your wallet), and not getting anywhere with Cingular over charges being deducted from her checking account, Mark really pushes me over the edge with his tone and attitude.

How much sense does it take to acknowledge that you are debiting a checking account for a cell phone account that has no relation; you'd think they would try to be a bit helpful. Their attitude in all conversations has been as long as we get paid, we don't care who's account the money comes from!

The Office of the President "Billy" has stated to me that "it is no different if I go take my boss's credit card and pay my bills with it. The bill companies are not to be blamed. Why should they have to suffer financially because of my theft. They got their money, there is no reason for them to repay my boss, nor any reason to interrupt my billing services."

Paul,

First let me say that I completely understand what your sister is going through. I had a very similar experience but with AT&T. A man in the next town over from me obtained my personal information from one of AT&T's customer service agents (complete idiot). Needless to say the guy went to town ordering cell phones and equipment under my cell phone number and my account number.

When I got my bill in the mail, I almost passed out. The best part of all this is that when I called to dispute the charges, the customer service agent was so dumb she admitted fault but refused to take the charges off of the bill. Her name was Maria, and she actually admitted to me that my social security number was given out along with my password on the account.

When I asked for a supervisor or manager they refused to transfer me and just kept telling me that I was responsible for the charges (yes, even after admetting they made the mistake)! I told them I wanted to cancel my contract because I felt that they breached their end of the contract when they gave out my personal information.

I must have fought with them for about three hours and got absolutely nowhere. I ended up going to the police station and reporting the whole incident. After doing an investigation, they offered to handle the problem with AT&T by talking to them and telling them what they found. Years later, Pressler and Pressler is trying to sue me for the amount of the bill from AT&T.

Truthfully I have gone crazy getting all of the old police reports and sending them out, but the bottom line is that you're going to have to try and file a police report for fraud and report Cingular to the Attorney General's office as well as any othe company you can. It's a lot of paperwork but it's worth it. Had I not filed the police report I probably would have had to pay that bill.

Just keep fighting, it'll work out in the end!! Also, cancel your credit card and get a new one, this way they can't keep billing you!!
