On October 24th, 2007, my wife ordered a pre-order diecast car from Copperstate Racing. We have waited for the item to be available for over a year. I checked with American Diecast Company and the item was released in mid February of 2009.

I still have not received the diecast car even though it has been paid for the entire time it has been on order. Today I discovered that the company has gone out of business and I want my money back ASAP!!

They have your merchandise you paid for, as well as all of Copperstate's inventory:

I understand they may be trying to run and hide again, now that people found them under their new name.

All they do is tell everyone to file chargebacks, which is messed up because they still have your money and merchandise, and are now selling it again to someone else for more money.

It explains why you shouldn't expect action from the AG. The company is gone, dissolved, no longer in existence. Who is the AG supposed to go after? I agree that it sucks when a company goes out of business while holding on to your money, but most companies that go under will be holding someone's money. As I said, if it's a significant amount, get yourself on the list of creditors. Otherwise, move on with your life.

Not sure why the consumer suggestion posted says... be reasonable. What is unreasonable about paying someone for a product and expecting to get it? Is it unreasonable to be mad that these people took our money and were never heard from again? Where I come from, this is called theft.

Dan, if the company has truly gone out of business, what do you expect the AG's office to do? They can't go after an entity that no longer exists.

Do you know if they filed for bankruptcy? If so, you can contact the court and add your name to the list of creditors. By doing so, you might get a few pennies on the dollar after the company assets are liquidated. Most of the time, it's not worth the trouble unless they owe you a significant amount of money.

Complaint to Arizona Attorney General

I sent a complaint to the Arizona attorney general's office and received a notice from them stating that they tried to contact the company, but were unable to reach them because they went out of business. Consequently, there was nothing they could do to help get my money back and no further action would be taken. Thanks for doing exactly what I did!!! Another fine example of tax payer dollars at work.
