Well here I am a second time filing a report on a Dalcor Property. I live at the Berkshire Apartments in Houston, Texas. I made a report already and had so many things wrong with my apartment. I have only lived here since Sept. 05. I was told that my apt. was ready to be moved into. Of course that was not the case. I started calling the first week to get things fixed and some of those issues still have not been fixed.

So fast forward to now. I ended up calling the corporate office when my bathroom wall fell in. Which the porter told the manager would happen and she told me he was a F **C K I N G idiot and did not know what he was talking about. It happened on a Saturday afternoon, they did not come and fix it until Wednesday. Finally he came and fixed it. He happens to live above me so we have become pretty good aquaintances. He told me that the 2x4's needed to be replaced. Which were rotten and eaten up by termites. He brought the maintanance man and the manager to my apt to show them and they told him just patch it up.

My tub also has been resurfaced 3 times. The last time being less than a week ago, has already started to peel up again. Then I got my water bill today that was $34.00. That is more than half the amount of my electricity bill.

When I called the corporate office I was given a major runaround. The head guy was supposedly in a big meeting and could not get on the phone. I told his puppet that if he did not want to explain to me why my apt. was not being fixed then he could explain it to the health dept. when they sent him the report. Less than 5 minutes later he was on the phone with the asst. manager. I know this because I called her and she put me on hold, when she got back on the line she told me it was Randy Pitts. That must have been a quick important meeting. So after my apt. was halfway done falling apart, I called back to speak to him. I was told that HE DOES NOT TALK TO RESIDENTS. WOW Some people skills he has. He is a slumlord. He has had enough complaints on his property to be declared a slumlord. How much more has to go on before his a*s is out of business.

This property will be shut down before long. The health dept. came to my apt. There was raw sewage backed up in the pipes. There was feces and urine. When I turn my water on in the tub it is yellow and brown bits of, what I thought was dirt would come out. I found out it was feces. I am a single parent and being taken advantage of. But unfortunately for them, I work for an attorney who has agreed to see my case.

We found your report today, December 8, 2005 and interviewed the lead maintenance technician. He states that the affected 2x4s were replaced prior to repairing the sheetrock and that the damage to the 2x4s was caused by ants not termites. Additionally, the exterminator with whom we contract, treated yours and one other building for carpenter ants.

Your bathtub should not have peeled after being resurfaced. Lead maintenace stated that the contractor's job was defective and that it was redone.

If you know these to be false please report it immediately to the leasing office or fax or email: 972-769-2004, complaints@dalcorcompanies.com.

As to the water, sewer and gas bill; over the past year the water/sewer rate charged by the City of Houston has increased over 15% and the natural gas rate charged by Centerpoint has increased over 58%. These bills are allocated to all apartments whether occupied or vacant even though vacant apartments do not consume either of these utilities. We pay the allocated portion for vacant apartments as well the amount for common areas. This method is one of the prescribed methods under Texas law. A resident may review the actual water, sewer and gas bills at any time. We have limited control over utility consumption and no control over rates.

It appears as though there was a sewage backup, which unfortunately happens without notice. We apologize for the inconvenience, but more importantly was it corrected? To our knowledge it was.

No one is trying to dodge anyone; unfortunately telephone calls to not always get routed to the proper place, use the fax and the email as well as the telephone.
