hurricanes frances & jeanne occuring in september, 2004 caused extensive damage to property of insured however, company denied liability for loss of fencing & pool enclosure.

policyholders who acquired or renewed policies sfter july & before september were covered for such loss.

barrier island property insurance could only be acquired from citizens & was renewed automatically.

the company doubled the deductible provisions of the policy by reducing loss for "depreciation" in violation of state policy.
