On May 19, 2021 I used the website Vrbo to book a Desert Airbandb rental in Tucson, Arizona for 5/22/-6/01/2021. After having used the instant booking feature I was sent a higher nightly rate adjustment along with an additional $225 in fees, only $50 of which were for my pets.
I let the owner of Desert Air Bed & Breakfasts, J Taylor Bard, know that Vrbo would require me to cancel the original reservation in order to have a new invoice adjusted.
In the day and half that it took for the payment to be reversed, so that I could rebook those dates with the new fees added, I continued to be in contact with the property owner, as had Vrbo, over those 36 hours.
When I went to rebook, the owner let me know that the property became "unavailable". Rather than refund me immediately, as his contract states, or provide me with the option of another rental for my dates exact dates, they have several, Taylor moved my reservation dates without my permission or even asking.
The contract provided by Desert Air Bed & Breakfasts LLC:
UNAVAILABILITY OF PROPERTY In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of Rental Agent, Rental Agent will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, Rental Agent shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated and Guest and Rental Agent shall have no further obligations or liabilities in any manner pertaining to this Agreement.
The owner of Desert Air Bed & Breakfasts LLC, J Taylor Bard, refuses to refund me the $1065 I paid to Desert Air Bed & Breakfasts LLC.
