Today (Nov. 19, 2013) I checked my bank balance and discovered an unauthorized withdrawal by Dish Network last Thursday. Many customers have complained about this unauthorized use of their cards, but I am not even a customer. I helped a friend restore her service early in September by making a payment to Dish Network. I never signed up with Dish myself, but Dish kept my card number on file. Although the name on the card is not the same as the name on the account, they billed it anyway.

Dish claims that the charge will be refunded, and that I will get the matter resolved within 48 hours. However, as a result of the unauthorized charge, my balance went negative and I also got bounce fees from my bank for some legitimate withdrawals that would have been good without Dish's theft from my account. As a customer, some people have been burned by the fine print in their contracts. However, it is clear that Dish is not concerned by legalities, since I never signed any agreement with them. They stole from me because that's how they do business.

More to follow as this case develops.

Dish answers

AUTHOR: tom c - ()

POSTED: Tuesday, November 26, 2013

A week after I filed my complaint and was told to expect results? in 48 hours, there is still no contact from Dish. Last night I checked the online account involved in the unauthorized charge and found that a week after I was told that my debit card information would be deleted from their database, it is still listed on the internet bill pay form. Today (Nov. 26) I called Dish again. After being disconnected twice, I asked the customer service agent to speak with a supervisor.

In order to get to a supervisor, I had to repeat my story to the customer service agent. Since the original complaint, I have found out that my friend tried to pay her bill on the telephone using her own credit card. After entering the type of card, her name and number, the Dish computer still used my debit card information. The supervisor said she must not have followed the prompts correctly, and that they keep the card info on file that is used to open a Dish account. I explained to him that the account was already opened and it was opened with my friend's credit card information. My debit card was used for a one-time payment in September. I told him that my friend was about to make another payment using her card and I wanted to be sure it didn't get charged to my account again.

He said that it should have been resolved in 72 hours, and said he would refer me to the Office of the President. After a long time on hold, he came back and said he couldn't get through to the Office, and that the Dish network could not do anything about a refund, they couldn't do anything about the bounce fees they caused, they couldn't even assure me that it wouldn't happen again. He said that my bank would have to dispute the charges.  I told him they already had and that I would now be filing a police report. I'm just waiting for a reply from the Attorney General's Office as to whether anything Dish had done was illegal under Massachusetts law. If a person had misused my card information like that, said individual would have been arrested already.

follow-up

48 hours have passed and no response from Dish.

Someone has suggested that I exposed my card to this unauthorized withdrawal by paying my friend's bill. After years of marketing that debit cards are "just like cash", am I supposed to believe that any time I use my card I must now explicitly state that it is a one-time usage and demand that the number be deleted from a database? I know that when I pay my cable bill to a reputable company, the web site asks me if I want to sign up for automatic payment. It also asks me if I want my card number to stay on file. I know that Dish did not ask my permission, and I am not even their customer. Why would they assume they had my permission for a future payment? It was also suggested that they did not know if I were the boyfriend or the father of their customer. Aside from the fact that it is none of their business, even if it were true, unless I co-signed the contract, I would not be responsible for the bill. You would expect at the least a copy of a contract if you signed one. As I said earlier, I think this practice is illegal in Massachusetts. If it is legal, it is clearly unfair and deceptive, and it should be illegal. I expect an answer from the Attorney General's office. I will post again.

Who are you?

Are you a shill for Dish or just a know-it-all? You may be spouting the company line, but I don't believe it is legal in Massachusetts. We'll see if the company has the same callous attitude. Stay tuned.

By Proxy

AUTHOR: Tyg - ()

By you paying your freinds bill you were put down as the card of record. This means that if your freind cancels their services and they have a ETF YOU will incure the costs. You need to get your card either removed from her account or you need to get a new card. It is unfortunate but its also in their contract that SHE signed. By you paying for her you have opened yourself up to a world of trouble.

When you paid for her account you made yourself the proxy payment. Think of it like a co signer on a loan. Im 100% sure you didnt tell the ppl at Dish that you were just doing a favor for a freind. They do not know if your a boyfreind or her father. All they know is that YOU made a payment on her account. It was HER responsability to get you removed off of her account. Dish is under no obligation to pay you back for your incured NSF fees. The person YOU need to be addressing is HER. SHE needs to pay you back the NSF fees. It was her inability to pay her services with this company.

Yes it is uncomfortable and a bit of a pain in the a*s to deal with. Consider the lesson learned. When you do a favor for someone with YOUR money there is ALWAYS a catch somewhere. So if anyone asks you to pay their bills with your card. TELL THEM NO!
