My son took out many student loans for his education. He is very diligent about making his payments. He consolidated ALL his loans into 2 payments. Out of the blue this company contacts me and says I owe $5,000 for my sons loans. I never signed anything or committed myself to any thing of this sort. I am a paraplegic and if I were to be involved we would have used other loans for such circumstance. They are now harrassing me. making threats to take my public assistance. I demanded to see some paperwork to prove I owe this money. They ignore me.

Lynda,

First of all, STAY OFF THE PHONE!! Never speak to any debt collector on the phone! There is absolutely no reason to ever speak to a debt collector, as it will never do anything positive for you, and will almost always make things worse for you.

Demand that everything be in writing.

IMMEDIATELY send a CEASE COMMUNICATION request as per your rights under the FDCPA. Send this by certified mail, return reciept requested. be sure to put the certified# on the letter itself, and keep a copy for your records.

Now, as soon as they violate your request, file an immediate lawsuit. You can get up to $1000 in punitive damages plus costs, and actual damages.

Hold them accountable!

Don't get mad, GET PAID!!

They are making illegal threats, hoping that you don't know enough about the law, and you will be scatred into paying them what they want.

Your son is an adult, you are not responsible for his debt, and they cannot hold you liable for it. They only way they could, would be if you co-signed the loans for him, which you said you didn't. They cannot take your public assistance, even if you were responsible for the debt, and they know that, they're just hoping that YOU don't know that.
