This league is not organized period! On 7/25/11 I enrolled my two grandsons ages 5 and 8 into the flag football league. I paid $50 per child. On 8/27/11 we went to the Hampton Inn for a team meeting and to pay for uniforms, another $50 out of pocket. Since then we have gotten the run around from them.

On 7/28 I received a call from the team coach stating that the games had been pushed back 2 weeks due to not enough players on our team.  On 8/10 he again called me and stated at that time that he believed this was a scam.  He stated that the kids would be assigned to a new team and that we would have to wait to hear from Diversity to know what teams they would be on and that the uniforms were on hold until the kids were on a new team to avoid having to purchase new uniforms.

I then emailed Diversity on 9/10 to questions what was going on. They stated that our team was going to be combined with another team and that the uniforms would not be ordered until they had been assigned. They stated I would be contacted as soon as the boys were re assigned. They said this would also allow for extra practice with the new teams. To this date they have not been assigned and have not practiced in 5 weeks. The games start this week and this team has not been assigned.

After several calls to this company I finally got a call today after threatening them with news coverage and Rip Off. They stated they cannot find placement for this team and that the original uniforms were in fact ordered and that I could have them. Why would I want a uniform for a team that does not exist? They have done nothing but lie via email and since I have started complaining they have since removed their address from their website. Beware of this scam....do not let your kids get let down like mine have and save your money!!

Dear Diversity Youth Sports, LLC:

Many of your statements about Diversity Youth Sports, LLC in your e-mail postings are untrue and defamatory. You made them maliciously to injure Diversity Youth Sports, LLC in its trade, office and profession. As such, they are defamatory per se. Under O.C.G.A. 51-5-11, this letter constitutes a demand for immediate retraction in writing of these false and
libelous statements. In accordance with O.C.G.A 51-5-11(b)(1)(C), Diversity Youth Sports, LLC demands that your retraction and correction be accompanied by an editorial in which you specifically repudiated your libelous statements.

Your web postings and conduct also constitute tortious interference with the business and contractual relations of Diversity Youth Sports, LLC. As such, they are actionable and expose you to the imposition of compensatory as well as punitive damages.

Below, we have noted some of the more patent, malicious, and libelous comments made by you in your e-mails and posts; some of them also evidence your tortious interference. If Diversity Youth Sports, LLC is forced to file suit to
stop your wrongful conduct, it will also seek an award of its attorney fees, litigation expenses and damages from lost business to be determined at a later date.

(Note: Complaints were not numbered in the original letter-I have done so here so each can be easily addressed)

In your BBB complaint you stated: On July 25th I signed my grandsons up to play flag football with this organization. I paid $50 per child.  On August 27th they held a meeting at the Hampton Inn to discuss teams scheduling and also to allow the kids to meet team mates. The coach then scheduled a total of two practices and then they held another meeting on September 10th to let the Summerlin team know that due to the fact that our team was so small they were pushing the season back two weeks in order to place the few children on this team with another team. I was notified by telephone by the coach of this. I email DYS to find out what team they would be moved to and when they would be practicing. They did respond but not to my satisfaction. They stated that the uniforms WOULD NOT be ordered until the boys were placed on another team and that they would let us know as soon as that had happened. Weeks went by with no word, no practicing, nothing. I emailed again and was told they would check with the coach and get
back to me. That never happened. I called DYS and as usual got there VM so I left a very stern message for a call back, mentioning I would call Ch 13 if they did not call me back in a timely manor. They called back within minutes
and the young man I spoke to was very nice but had no answers, only that they were still trying to place the boys. The season starts today so that got me very irate. I paid a total of $150 for this and the games were starting without
these to young boys ages 5 and 8. The man on the phone did say I could have the uniforms for the team that no longer exsists which then really upset me since I have an email from DYS stating uniforms would not be made UNTIL the kids were on a new team. I do not want uniforms for a team that is not playing in the league, that is riduculous! I did contact CH 13 since our conversation was going nowhere and the gentleman on the phone really had no reasonable answers.

My compaint is due to lack of communication,no placement of the boys on a new team as promised in writng via email. I have emails that contradicted what I was told yesterday when I called and to top it all off, after the call ended I
got an email from DYS stating that both boys are now suspended from the league for 1 year due to breaking the conduct code. I went to their website and read the code and now I understand why they did this. If you are accused of breaking
the conduct code you are not entitled to a refund. I now have 2 boys disappointed that they are not going to be included in the football season and I am out the $$ paid for no service rendered. We did sign a no refund contract
upon signing up however I feel that we are due the money back since they failed to place these boys on a team and are just starting the league without them and for the uniforms that we do not have or want since the team they were made for does not exsist. The suspension leter did state that if I wrote a letter of apology to them that within 6-8 weeks they may reconsider these boys suspension. THEY should be apologizing to these boys for not following through
on written promises made and for dropping the ball and not contacting us with new team info and practice schedules for the new team THEY WERE NEVER PLACED ON.   

 
2.  In your rebuttal to our answer you stated:  I never told DYS that my grandsons father was on a drug binge and I never acted irrational. The team paractice twice only. Once for one hour and once for 45 minutes. How any team parents could be concerned about myself is ridiculous due to the fact that they had never met me. I never went to any of the two
practices, the Hampton meeting or the parent meeting after the second practice. The only time I was involved was when I went to sign these two children up at Cicis Pizza.I did not step in and question this league until  Bobby called me to state that the team had to be merged with another team due to the small size of our team. He stated that since that was going to happen he was no longer needed as a coach. I have all email correspondnence to and from DYS and I was never irrational, just concerned as to when these boys would be assigned to a new team.  Bobby Moskowitz has not violated his parole and to my knowledge is NOT on a drug binge, he moved to Utah. I was unaware he was going to be the coach until my daughter came home from the meeting at the Hampton Inn and told me he showed up and volunteered. The statements made are fictictious at best. I did state he was a convicted felon but never stated he
was on drugs and never stated he was on a drug binge and this is a fabrication as well. I did receive an email from channel 13 stating that DYS was refunding me the cost of the uniforms, has this changed as well? As for the refund
policies, when I was at Cicis an insurance company came in and was promply asked to leave, they stated they did not 
need insurance due to the fact that this was a non competetive sport so how can they state in the above refund policy that money has been spent on insurance? My grandsons are being punished because we dared question the
practices of this league. I emailed them several times and will be more than happy to forward those to you to prove I was at no time irrational, always courteous and polite and grateful for the help. They never replied to my last two emails and that is ewhen I called them. The gentleman I talked to stated he had talked to my daughter as well and that he just did not have a team to place them on. He did offer to move them to kickboxing at no extra fee and it was not
until I complained to Ch 13 that they turned these two children away from the league. I will be contacting Bobby in Utah and alerting him of these ficticious accusations they have stated we said. I did contact this company from my job
where all calls are recorded and I am confident that if I have the IT department pull that conversation they will prove that I was never irrational.

The coach is not in jail he is in Utah working. He left the league because there was no team to coach as they only had 5 players and to set the record straight we only had 2 practices not numerous ones so lets try to be a bit honest here DYS. I will no longer go back and forth with your half truths and innuendo's. This has been turned over to our attorney.

bounds of free speech. Your failure to correct your erroneous and false statements and their repetition after notice of their falsehood constitutes further publication of libel. It also confirms your malicious intent.

If you do not immediately publish the requested retraction, and cease and desist from tortious interference and making false and malicious comments about Diversity Youth Sports, LLC, it's officers, and its programs, we will file suit against you. Please govern yourself accordingly.

I never stated my grandsons father was arrested. He is an ex felon, that is true however I never stated he was on a drug binge, you yourself alerted ME of that, stating that came from another party. I had a problem with him being a coach from the very beginning as he did it as a way to try to make up for lost time in his sons life.

I never went to any DYS meetings so it is very impossible to have parents complaining about someone they have never met. I only went to Cici's to pay the enrollment fee period. That is where my involvement ended. Chanel 13 States that they did not agree with you, they simply placed a call to you and that you agreed to refund the uniform cost only which we have not seen to this date. Thank you for sharing your concerns with DYS.

Your grandchildren were placed on a flag football team that your grandson's father volunteered to coach. This team went weeks practicing and then suddenly the coach, your grandchild's father, stopped answering phone calls and did not show up for practice. Almost instantly, we began receiving concerned phone calls from other parents of the team about this coach and your family. As we continued to look into the situation, we found out from you, that the coach (your grandson's father) was "arrested because of a drug binge he was on and for violating his parole for armored robbery". Between the irrational
conversation's with you and your statements that the coach (your grandson's father) being on a drug binge, DYS was forced to take action to uphold its legal responsibility and the code of conduct we promise our other parents and
their children. You and your family were suspended from the league for a period of 1 year. We have explained our position to channel 13 also, and they agreed with our position. Going to different agencies, will not change the actions that were taken because of your own acts.

Per our code of conduct, "Interscholastic and youth sports programs play an important role in promoting the physical, social and emotional development of children. It is therefore essential for parents, coaches and officials to encourage youth athletes to embrace the values of good sportsmanship. Moreover, adults involved in youth sports events should be models of good sportsmanship and should lead by example by demonstrating fairness, respect and self-control."  More can be viewed at: http://diversityyouthsports.com/a/?page_id=299

Additionally, please review our refund policy: "In general, Diversity cannot offer refunds to its participants. These funds are immediately used for the needs of the league. 1. The league has a strictly enforced NO REFUND policy. 2. There are no exceptions to the NO REFUND policy. 3. The NO REFUND policy includes no transferring of funds of any type. 4. NO REFUNDS will be given due to player injury. An injured player is still part of a team. 5. NO REFUNDS will be given if a player quits, is removed from a team, or decides they don't like the sport. 6. NO REFUNDS will be given if a player moves out of town.7.

Diversity uses the registration fee to cover the cost of many non-refundable player costs including insurance, fields, officials and equipment. Diversity does not receive a refund on these costs and therefore we have no way to give a refund to you. We apologize for any inconvenience. I understand that Diversity has a NO REFUND POLICY. There are no exceptions to this policy. If for some reason your sport or division is cancelled, you will be given a credit for a future season. If no future season is offered, you will forfeit this registration."

Diversity Youth Sports is a community based non-profit organization with the goal of bringing families closer together through the participation in youth sports.  The last thing we ever want to do is prevent children from playing the sports
they want to. That why we have donated over 100 registrations to underprivileged children across Southern Nevada this season alone.

Diversity Youth Sports practices and promotes individual core values by providing opportunities for everyone to build strong kids, strong families, and strong communities. The mission of Diversity Youth Sports is to develop the total person-spirit, mind and body-through character-development programs that build strong kids, strong families, and strong communities.
