DOMAINS BY PROXY, INC

My experience with this company has allowed me to see what a rip-off they are. A while back, I had registered a new internet domain name and with that, I had signed up to keep my "WHOIS" private. Well, a situation recently came up and they disclosed my information. When I told them they were in breach of the agreement and demanded my money back, I was given a song and dance on how they will not be able to protect me if they return the money. The sad thing, and after multiple demands, they keep making excuses and intentionally avoid giving me a refund. Hopefully this company will release my money back to me.

This has been my personal experience.

Under what circumstance did they divulge your information?

FYI all ISPs/domain registrars are required to divulge domain owner information to comply with court orders or subpeonaes that are part of a law enforcement criminal investigation or civil lawsuit/arbitration (ex, WIPO arbitration proceedings for the rights to a domain name.)

Additionally, the ICAAN rules clearly state that the correct identifying information is supposed to be listed under WHOIS. Unfortunately, many companies offer a "proxy" service to hide the domain owner's identity. This practice, although a violation of the rules has NOT YET been tested in U.S. courts.

Paying for a "proxy" service is no guarantee that your information will not be given out. However, most registrars have a written policy that clearly defines under what set of circumstances they will release the information. Have you checked your contract with them (terms of service?) If they violated the TOS/contract then you might have recourse for a partial refund.
