I am complainting about this mortgage company because they have ripped me off. First of all they brought my loan from another "bad" company and jacked up my original loan from $25,000 to $34,000 saying that is the amount that they finaniced. I got this orginal loan in 1995, and have been paying them this money back for ever. So far I have paid them $86,698 and still owe them $30,743. Now when am I suppose to ever get through paying them? I need to know if I can file a lawsuit against them as soon as possible so that I can get some of my money back. There is no fairness out here for us we are the victim every time. All we do is pay! The problem is is that I don't mind paying but I do know that this is not right. It seems that I can't get thorugh with this loan. If there is a lawsuit where can I sign up. I feel something needs to be done about these type of companies. However I have contacted the Attorneys Generals Office and the Consumers Banking Association of America and filed a complaint. Maybe this is something that others may need to do as well because they may me able to help. They are suppose to be there to protect consumers from this type of fraud.

All of us that have complained about EMC know the stress and unfairness that you are going through. We are ALL victims of EMC Mortgage Servicing. I have noticed in your post that you complained to 2 places. From experience, all I can say is Good Luck. I have complained more than just a few times to every local, state, and federal agency (FTC, BBB, AG for my state and Texas, state Governors, Senate members, HUD, Office of Financial Regulation, etc.), and including The White House on a daily basis. The only response that I have gotten is, "We understand your concerns, however, we do not have the jurisdiction to intervene with your situation. Please visit these websites (attached to their response are the websites) if you feel that you may be facing foreclosure." If they don't have jurisdiction, then who does???? Nobody.
EMC is not regulated by Fannie Mae or Freddie Mack, therefore, the government agencies will not even bother with our complaints. I know this from experience. Please refer to my post on this website on January 18, 2009. I currently am having my documents reviewed by a certified fraud examiner in south Florida.
Due to the fact that I have no way of contacting you or informing you how to contact me since this website forbids it, all I can suggest is to Google "EMC Mortgage Fraud". There you will find hundreds of websites to post your complaint. I think I have hit just about all of them. I have done extensive research on this company and NONE of it is positive.
I have gotten a tremendous amount of help from Denise Richardson's website (((Redacted))). She is one of the best consumer advocates (as far as I am concerned) for victims such as you and I. Also, check out (((Redacted)))for a wealth of information.
Of course you can file a lawsuit against EMC, but you will have to contact your own lawyer. I am not aware of any class action lawsuits that are currently in process or in the early stages of, that you could join.
