Florida's Best Realty Services is trying to steal my security deposit on a monthly tenancy lease that is supposed to be for a whole year.  Florida's Best Realty Services has the money in their escrow and is refusing to give it back to me just so they can keep it for theselves. I am a single mother that needs this money to take care of my family and find someplace to live. The place they tried to get me into is also going into foreclosure next month and the lease does not have any move in or move out dates filled in, many parts are unreadable and marked several times. Florida's Best Realty Services is only out for themselves and not for there clients at all. Do not trust Florida's Best Realty Services. Florida's Best Realty Services will steal your money and get you into monthly tenancy leases that are supposed to be for a whole year and not tell you so Florida's Best Realty Services can just keep their commission, all Florida's Best Realty Services cares about is Floridas Best Realty Services And not there clients.

Dear client,

In our 12 years of professionally practicing real estate in Boca Raton, we have never encountered a negative review or a dissatisfied client that has gone to the extent that you have.  We always do the right thing and stand by our clients; however, we also need to deal with rational and truthful situations in order to handle them appropriately.  If you had an experience which was not to your liking, you should have contacted management via email, phone, website or walking into our office which is open 7 days a week and we gladly would have addressed ANY concerns.  Without exposing your name to the world (as you have done to us here), we kindly reviewed your reiview and any documentation attached to your flie.  Here is the truth of the matter, all of which is fact and not simply based off of an opinion or assumption.  I sincerely apologize if there is a misunderstanding; however, the facts must be stated clearly so we are all on the same page and not simply pointing fingers.

 

1. You claimed that Florida's Best Realty is holding your security deposit hostage.  Please note, we do not ever hold security depsosits under any circumstances.  We are in a highly regulated industry and the only deposits we hold in escrow are for either 1st month on a lease, or a binder deposit on a purchase.  To clarify, your deposit was for your first full month rent, not security. (I know this is just a technicality, but it is a big one).

2. You claimed that we won't refund your your deposit: Please know that upon fully executing a lease and obtaining HOA approval (as you have) all funds are released to the landlord as per our lease and memo to lease.  Any disputes at that point become a landlord and tenant issue, not a brokerage issue.  We followed exactly what our contract stated in big and bold letters numerous times.  We even asked you if you wanted to find another home to live in, and our agent continuously stated that if you weren't happy, we could try to get you out of the lease and find another home.  The issue is that there are no other 2/2s in Boca Raton for the price range that you were looking for that would accept your credentials, etc.

3. Move in- We attempted to move you into the unit numerous times, both on Saturday October 25, and Sunday October 26.  I can attest to this because I persnally sat at the unit from 2:45 pm until 3:25 pm in anticipation of your arrival for the scheduled 3 pm move in.  This was despite the fact that on Friday and on Saturay you texted our agent that you weren't moving forward and wanted to cancel your move in.  You then contacted us and said that you changed your mind and would move in at 3 pm Sunday.  I sat and waited for you and you didn't show up. You stood us up for your own move in even though the owner of the company personally went to let you in on a sunday afternoon.  Yes, I left my baby and pregnant wife at home just to do the right thing and meet you at the condo, but you stood me up, didnt answer calls, and I waited 20 min past your scheduled time to meet....  The addendum to your lease was put on the kitchen countertop for you as per your request, but you never brought your move in balance so we didn't disburse keys. 

4. You claim that the unit is in foreclosure: We ran a complete title search on the unit and unit owner (even though we weren't the listing agents) and found out that there is no lis pendens or pending foreclosure on the unit.  A title search for the name and cross name LIU PIK W came back clean as of 10/26/14.  In addition, even if the unit were to to into foreclosure, the HOA has a provision that they will receive all rents due, so as a consumer, you would have been protected....Likely, it would have worked out in your favor rather than to your detriment.

In conclusion, I understand that you are frustrated with personal matters in your life; albeit, this isn't a reason to reflect anger and hateful emotions at those who are actually trying to help you.

I simply wish you had confronted us and been cordial about your approach rather than slander and maliciously try to extort a refund of your deposit due to buyers remorse.  We would have actually represented you and tried to get you out of your lease as we offered to do, but your inconsistent actions made it nearly impossible to judge your true intentions.  I'm afraid that this report which is mostly fabricated and false in nature has actually back-fired and has now put us in a defensive position which we may seek legal remedies in order to repair the potential damages that this can cause.

With all of this being said, we are still open to communicating with you in an effort to resolve your concerns.  As always, we are accessible literally 24/7, and unlike many larger firms/brokeages, you can call the broker and or owners any time to address your concerns.  Hopefully this will shed some light on the fact that we are indeed a business with integrity, and perhahps you simply had a misunderstanding.
