Payless Auto Sales SOLD US A LEMON .....

I needed a car desperately so I went to Fresh Start Motors. The car that I purchased was a 1999 Chrysler Concorde. This purchase was made in February 2002. One week after the purchase the car started running hot and had to be taken back to Fresh Start Motors, where they were suppose to have changed the oil and work on the wiring. In the meantime they gave me a car to drive while they did the work, once they were finished and I picked up the car it ran for a little while longer. In April the car broke down again and this time it wouldn't start at all.

I called the car lot back and this time as the last and the very beginning I talked to Benjamin Boyle, I told him what the problem was and I also told him that I couldn't afford to pay for a rental car and have the car towed to the lot. Ben then said that they could give me a loaner car as long as they did the work, well that seemed fair enough.

On April 23, Fresh Start filed a claim with Guardian Warranty to repair the engine, head gaskets, the timing change and the oil pump. Tom from the warranty company went out and looked at the car and approved $1600.00 for work to be done. In May I was told by Ernie Frances that the warranty company had been trying to contact me, when I called them they said that wasn't true because they had already approved the work to be done.

On June 6, I went over to the lot to pick up my car and to pay my deductible for the warranty. I paid the $50 deductible to Ben, who signed the reciept with the owner's last name which was Rhima. I drove to the gas station down the street and then on to work where I called Ben back about the car and he said to bring it back, which I did, and was put back in the loaner car which was a 1999 Oldsmobile Intrigue.

I started dealing with Ernie Frances because Ben went to another lot. Ernie said that the guys were going to try and find out what the problem was, after they couldn't do anything then Mike Rhima the owner said he had sent the car to a Chrysler dealer, this was in mid July early August. After they go the car back I went back over to the lot to pick up the car again and drove to Arlington to pick up my daughter and the car was still jerking really bad and I called the lot and was told by Ernie to bring it back, which I did.

Mike then told me that he knew someone that felt like they knew what the problem was and he needed one more week to try and get the car fixed. As it turned out he sent the car to a place called Affirm Automotive or Autos which was across the street only to find out that something had been done to the wiring and it was going to take a additional $1000 to fix the car. I talked to the man there at Affirm, his name was John and he told me that Fresh Start never told him the car belonged to a customer and that the car sat on his lot for about three weeks and he had to get it back across the street.

At this point Mike didn't want anything else to do with the car and he told me "I don't know what is wrong with this car, just come and get it out of my hair". When I asked him about buying the car back he said that he couldn't, but he didn't have a problem selling me the car I was driving which is what I had been asking him to do, but he wanted me to just make my payments to him and let Auto One be a voluntary repossesion, because it wouldn't look that bad on my credit.

I am a single hard working parent who is also a student and I informed them of this when I purchased the car. As of Saturday 11/9, they got their loaner car back and my car won't move and I am back to square one, no transportation for me too get to school, get my children to school, get me to work, or us too church, we have no transportation at all and I am still stuck with a $13,400.00 bill for this very large LEMON that Fresh Start Motors sold me.

Since filing a report with ripoff I recieved a letter from the Attorney General's Office with an attachment from Fresh Start Motors. This response from the car lot to the AG's office states that they had been to my house at my request to pick up my car because I called a week later to say that it had died in my driveway. They also stated in their response that they had paid $870 to Alan Samuels Dodge for repairs, but they told my mother Retha Biscoe that they had paid $4000 in repairs and Mike Rhima told me in August that he had spent $1000 in repairs. I have never been told what Dodge/Chrysler house they took the car too. They included it in the response to the Attorney General's Office. Mike Rhima makes mention that I called them a week later to tell them that the car had broke down, well I did call Benjamin Boyle twice, the first time was when the car ran hot and they had to do some repairs and yes I did pick the car up and it did run fine for a while. The second time was when they went out to Bedford to pick the car up because it had blown up and had a huge hole in the engine. These people have yet to acknowledge the wronge that they have done to me and my family and they want to make every one believe that it is all my fault I really need some help. I am a single parent that is also in school and I work full time and I work 2-10pm therefore I have to find ways to work, school and home daily. My family and I have not been able to attend church service since November when I drove the loaner car back to the car lot and they towed my car to my mothers house.
