Fulton County Board of Trustees in 2012 awarded  Back Pay  with interest to Retirees who were underpaid in a Class Action Suite Charlotte Burnett, et al v. Board of Trustees, et a. Civil Action File No. 2010-CV-194160. It was agreed  Attorney David C. Ates receive 30% of the back benefits amounts plus $25 out of pocket per Class Member (2000 members approximately) and no attorneys' fees will be sought with regard to Future Upward Adjustments of monthly benefits.

I received notice dated April 15, 2016 that final caculation determine an additonal adjustment in my salary in which I was underpaid. Based on the award amount I will only receive 23% of this adjustment. I contacted Alysa Freeman who is now the Attorney representing the Retired Employees and she stated to me that I am better off than the Retirees who were overpaid. Retirees who were overpaid will not have to pay back however their salary will be recalculated.

This order was signed on March 11, 2016 by Judge Constance Russell, Fulton County Superior Court.

Left message for Tammie McGallon, Fulton Co. Finance Dept. (404) 612-7672 and Chief Gary Styles, Fulton Board of Trustees (404) 613-5712 (04/27/2016).

Ms. Elaine Greer did express some employees salary will be reduced as much as $400 per month and one employee was caculated over $9000 leaving him/her less than $2000. She was unable to provide names of the employees affected by this suite.

I look forward to hearing from you and I have copies of the correspondance in reference to this suite that I will share with you if you desire.
