I was nearly 30 days overdue on my payment, which means the current month's payment was also almost due. I don't dispute that fact.

Despite both a previous verbal and written request, the collections department called my mother again. Not only did they call her, they TWO of our neighbors!

All this for $82.50, which had already been paid online....

I thought it was unethical, if not downright illegal, for someone to contact not only you, but a family member, after a written request had been made. And to call our neighbors and try to pump them for information was just too much.

If they are third party collectors, the FDCPA applies.

If they are in hose collectors for the original account, the FDCPA does not apply, as it ONLY applies to third party debt collectors.

However, it is a privacy act violation to discuss a persons debt with a third party.

And even with a third party debt collector, they can only contact a third party to establish your whereabouts, and usually only once is considered reasonable. And they cannot identify themselves as debt collectors or in any way indicate it is a collections call.

Just get statements from witnesses and file a lawsuit on them for the blatant violations of your rights. You can get up to $1000 in statutory damages as well as legal costs and actual damages.

Don't get mad, get paid!

Unethical collection practices

I used to work for the Help Card. Yes, in the collection department. The have a way of "losing" things and continue to do things their way. It is against the law to continue to call someone when you have sent them something in writing. You must send them a "cease" letter and send it to them by certified mail, and keep a copy of the letter you sent. The lady who works in the diputes department is not an easy lady to get along with. If it is the same woman, her name is Deb, can't remember her last name. When calling customer service, ask for Karen. She usually knows what is going on and she is usually nice about things.
