We've been in our condo building just under 18 months (new construction), and during that time we've had recurring issues with leaks from the roof structures.  The developer has made numerous "repairs," none of which have been complete and lasting solutions.

We know this for two reasons: first, because the condo board hired an independent architect/waterproofing expert to evaluate the roof structures and recommend a course of action for thorough remediation.  And second, because we still have leaks today.

Because the sponsor refused to adhere to our architects scope of work, and because of our rights under New York law, we retained legal counsel.  Our hope was that we could negotiate a reasonable settlement and put the matter behind us.  Instead, the sponsor and his attorney have dragged out the talks despite many concessions we have made since we first began.

Now we face another hard winter with inadequate roof structures. We expect the existing interior damage to get exponentially worse, and have recently learned that neighboring buildings that the sponsor also built are having similar problems.

It is clear that avoidance, manipulation, and deception are his primary tools in doing business.  It brings new meaning to the phrase "buyer beware."
