On September 13 2005 we leased a car from Infiniti dealership at Coconut creek Florida The car is Infiniti M35 Year 2006. It all started like any other car buying negotiation, when you go back and forth until you come to an agreement on price and terms. In this case the price was $554.88 a month ( this was my condition from start) based on 36 month lease.

And then the signing process began. I don't have to tell you how many paper work you need to sign. They hand you a bunch of forms and all you basically care is, that the terms you agreed upon won't be changed especially on a lease base the PRICE.when I was done signing, I was happily driving out the dealership with my new car.
A couple of weeks later I'm getting a letter from US Bank stating that for the next 63 month I'll be paying them $554.88.

I was sure that this is a Typo ( printing error, so I returned to the Dealer in order to correct this error.
I was tryed triedlk to the floor manager, to the salesman and to the financial department.They all laughed at me and basically said You signed it you eat it our attorney sent a letter to the Dealer but we never got any respond.I don't know if that was purposely misleading or a Typo issue. I know for sure that I had no intention to lease the car for 63 month. For that price ($34,954) + the residual after 5 years I would rather buy the car with money left in my pocket.
Please help us with your power to change back the terms to 36 months, (or, they can take their car back.) like we agreed upon from the first place.It is definitley adefinitelyoff. As long as it is an eror, and the dealer corrects it, it is considered an eror, yet, to leave us in that situation, that cost the difference of $15,000.00 between the agreed price and the contract that was handed to us - is a rip off, without any doubt. They should have, for the purpose of honest dealing, honest business tell me - these are the changes we made on the contract that are not as we all agreed. Any other way is Cheating, rip off, Dishonest dealing, Lieing, Fraud.

Who is the leasing company?

If it is the dealership -- an inhouse lease -- then yes, you are done. You've agreed to rent the car for 5 years.

If it's a financial institute, you should be able to challenge the contract. A mistake voids a contract when one side knew about the mistake and they gain benefit from it.

I'm pretty sure it'd be easy to prove that 63 months is a mistake, given the LEV would be on the contract.

My niece leased a VW Beetle against all advice from family. We even offered to help her financially, but she's young, a "smart" school teacher and wanted her independence. Now three years later she can't turn in the car because she's so over-mileage they will screw her, she can't even prove she ever did an oil change at their dealership, and they want the car back in like-new condition. Basiclly, she's now paying for a new Mercedes, and driving a three-year-old mediocre car with no value at all. Leasing is for suckers and lawyers.

Do you understand what you did? You stated "it started like any car BUYING process, going back and forth...". What exactly did you "buy"? You DIDN'T BUY ANYTHING! You got into a CAR FLEASE. Dealers love a CAR FLEASE because there's so much more profit than in a buy. There is so much more incentive, fraud/deception is even more rampant in FLEASING than in a buy. Why is a CAR FLEASE so much a bad deal?

1. Your insurance will most likely be higher than in a buy.

2. You will be hit with numerous bogus phoney fees like an exaggerated "acquistion fee" and a "termination fee". Remember, just because it sounds official, doesn't mean its legitimate.

3. Your mileage charges may be calculated to stick it to you. For example, you may get into a 36 month FLEASE with 36,000 miles except that they calculate that on a yearly basis to maximize their "take". Like 14,000 one year, 10,000 the second year and 12,000 the final year. In this example you are still within the 36k limit but you'll pay 2k overages the first year. All this is designed to take your money.

4. You have agreed in-advance to pay what somebody considers excess wear and tear. This is a major profit center in the FLEASE. Guess what? After you write the check for the usual $500-$2000 they will pocket it and NOT have the alleged repairs done!

I'm tremendously sorry to hear that you got into this screwy arragement. I'm hoping you will NEVER do this again. As for the current problem, if you have a sign paper which says 36, then you might have a case. Otherwise, its their word against yours.

Remember, don't ever, ever, ever get into a FLEASE. When you get into a FLEASE, you will get sheared!
