KMA Real Estate Manaement LLC MCM Newark LLCKMA Services Excavating & Trucking LLC Has Work Performed and WILL NOT pay - Refuses to communicate in any way possible Newark Ohio

On December 29, 2015 our company T & H Builders were contacted by Vivian Henderson with KMA Real Estate Management LLC and MCM Newark Company LLC in performing a roof repair on a flat roof located at 70 East Main Street, Johnstown, Ohio. This is a multi unit complex, two businesses located on the bottom and several apartments.

Prior to performing the work on this property Vivian Henderson and myself discussed the price of $800 to $900 to patch the roof (torch down roof) as long as there would not be any further work that would need to be performed. I specifically asked Vivian Henderson what was the budget of the owner on this project and I was informed that the budget was unlimited and there was not one. At this time the property was inspected and pictures were taken.

Work was performed on this property on December 30th and completed. I contacted Vivian Henderson about the work was completed and the total amount of the work performed including material and labor was 1148.14. At this time Vivian Henderson did not state anything was wrong with the price, she stated she would contact Kim M Ault (owner) after she was done with her meeting in Columbus around 3 pm on the 30th. Vivian Henderson did not contact me back until the next day December 31st and stated she would meet me around noon and would pay me what she owed me. When the time came to meet Vivian Henderson sent me via "text" that she did not have all of the money that was owed to us but yet only had $200 of the 1148.14 owed. She was informed then that this was unacceptable and that I wanted all of the money she owed me. She insisted that I meet her. When I did meet her I was only given a check for $200.00 and stated that she would have the rest of the money. She stated that she would get in touch with me by Monday. I did not hear from her nor would she reply to any text messages until Wednesday. During this time I had contacted the Attorney Shaffer for the Kim M. Ault, who is the owner of the companies and has to sign a check. The attorney stated he believed it was a possible miscommunication between Vivian Henderson and Kim M Ault and he would pass the message to Mr. Ault.

On Tuesday, January 5, 2016 Kim M. Ault made contact with me via phone, and stated he would go an inspect the work and would get back with me. That was the last time that I have heard from Kim M Ault and as of today and the filing of this report he has changed his number and refuses to contact us back.

As for Vivian Henderson, she made contact with me  on Friday when she stated that we would get paid and that if she cuoldn't get him (Kim Ault) to sign a check ( which she stated that she took a check to him and he flat out told her he would not sign it and when she asked him why, he stated he wasn't paying it until he could inspect the property. This was told on Friday, January 8, 2016 and he stated to me that he was goning to inspect the property on Tuesday, January 5, 2016.) she would be getting paid cash on Sunday, January 10, 2016 from other units and could pay us with that money or she could give us a check that wasn't signed.

Here it is Sunday January 10, 2016 and neither one of the parties involved in this situation will contact me back. I have provided services for this company and now they are flat out lieing and refusing to pay. I will be contacting the Licking County Prosecutors office about fraud and Theft of Services or Deception charges being filed. It is my honest belief that this company along with Vivian Henderson took advatange of me owning a small family run business and knowing that we do not have a large capital to work with. I have been very polite and patient with these individuals only to be lied to about being compenstated for the work that has been completed for this company.

I can only advise other contractors or construction companies to be aware these people and his companies that you will not get paid for services rendered to them.
