I'm a college student who had finally saved up enough money to buy a car.  I was so excited for my purchase, however I didn't have help in finding a car as I was living in Miami without any family.
I shopped around for awhile looking to spend around $5,000 or so.  A lot of places and cars in Miami appeared to be shady to me, so i broadened my search to include Ft. Lauderdale.  I found a 2003 Hyundai Sonata for a little over $4,000.
I immediately wanted to see it, and I went out there.  The car appeared to look clean, and I checked all the things that internet check lists and carfax said to check.  I thought I was being a good consumer.  I decided i wanted to purchase the car.  Their cars are sold AS IS, and that's a major red flag, but who was I to judge?  It was going to be my first car and I was excited, and I also had the sense of "trust" in these two nice guys I dealt with. 
One of the guy was in his late 50s named Steve, but I can't recall the other buffoon's name who was in his 40s.  So I purchased the car and drove off the lot.  Now I live in downtown Miami which is about 40 minutes from Ft. Lauderdale, and the car drove perfectly fine, smooth and quiet. 
I then take a stop for some food with my friend.  When we left I go to start the car and it starts but it hesitates, so I give it gas and it works just fine.  Then I go out in the car about an hour later, and I'm driving on the FL 836 (Speed limit 55mph) up the incline right before the NW 27th Ave. exit and the lights inside the car start going crazy and the car stalls on me, so I quickly try to get over on this incline onto the shoulder, almost hitting a cop on the way. 
I make it over and the car will no longer start for me.  Now I'm stuck on an incline on the 836 with Miami drivers flying by me and my car is shaking as they pass by, a very scary feeling.  I call Kool Kars and Steve gives me a generic explanation about how the car is sold AS IS but offers me one of their extended warranty plans.
Then I have my father call and my dad was given the same exact response.  Now a decent car dealership would've helped even though it is sold AS IS because they don't want their reputation damaged.
This place wouldn't budge in helped or anything.  I had the car towed back to my apartment, and later taken to be fixed.  After all the damages, the repairs costs me a little over $1,100 dollars to fix.
We call Kool Kars and tell them and they don't have a care in the world that I could have been seriously injured on a busy highway or to how they screwed a 19 year old college student out of thousands of dollars.
On top of that when my father went to register the car back in NY where I am from, it turns out Kool Kars charged me NY tax that wasn't enough first of all, so my dad had to pay more.  Second off they shouldn't have charged tax at all, and didn't even send that into the state.  They just took the "tax" money and profited with it.
We wrote letter to the BBB, state attorney general, and so forth, all with responses that they can't help me.
I find it hard to believe that something couldn't have been done to further help me with this problem, however I don't want to see anyone else get screwed over, or to see Kool Kars make business ever again.

Low-Quality Business practices

Look, just because something is not illegal does not mean it is ok.

It's a car, cars are meant to be driven, and most people don't switch cars too often.

The car broke down in an unreasonable amount of time, everyone agrees with that. I'm fairly certain reasonable people don't pay 5-Grand for a car that doesn't run, and it sounds to me that that's exactly what was sold to her, unknowingly, and it just took 3-4 hours for it to get there.

Again, nothing Illegal took place, she knew full well there were risks--but come on, you posters actually defending these dealers, you can't say what they did was right? I'll ask dealers this - what Automotive Dealer still in business doesn't know the condition of the vehicle they're selling?

It's unethical, and these dealers deserve our scorn and derision - we as consumers shouldn't let them stay in business with our money if these are the products they are going to sell back to us.

No one should be sued, and nothing illegal happened, but this is clearly a solid case if there ever was one of:

Sleazy?

Yes, I suppose technically this dealer did nothing wrong, but shouldn't the car at least make it home?

I puchased one used cars 'as is' and before I got it home, one of the front ball joints came apart resulting in the front end landing on the street.  I was going slow so we didn't get hurt.  I had the car towed to the dealer who was embarassed and fixed the ball joint for me.

They didn't HAVE to because it was purchased 'as-is', but it was a reputable dealer who felt the need to help us.  Since then we have returned and have recommended them to other people.  None of our later purchases were 'as is' however. It pays to do the right thing.

I understand that they are not expected to fix every little thing but, good grief, a $4,000.00 car should make it home.  They just took advantage of an inexperienced college kid to unload the clunker.

Beware when any car dealer hides behind the BBB or plasters the BBB logo all over the place.  The BBB is a SCAM!  Anybody and I mean, ANYBODY, can BUY a BBB membership and BUY a BBB "accreditation".  The BBB sells these phoney accreditations the way other scam artists sell bogus dipolomas.

Nothing SLEAZY here?  Let me explain the BOGUS, ADD-ON, PHONEY FEE con-game.  The sleazy dealer advertises a BOGUS PRICE for a car.  Then they PAD it with so-called "dealer fees" and "processing fees".  Then they claim how honest they are.  A businessman who operates within the bounds of honesty and integrity, advertises the REAL PRICE for the merchandise rather than LIE TO YOU with a false low price and make up the difference with BOGUS FEES!

You may remember Bill Heard Chevrolet.  They faced a multimillion dollar lawsuit in Georgia and voluntarily shut down.  One of the things BOGUS BILLY was known for was his BOGUS, ADD-ON, PHONEY FEES.  They were a BBB member too!

Nothing sleazy here, right???

    This dealer did absolutely NOTHING wrong here. The op never did say how many miles were on the car or what was wrong with the car, from what he describes it sounds like an alternator which is an electrical item which can go at any time without warning. If indeed it was an alternator you might want to look at the repair shop that charged over $1100.00 to replace it!!!!

Car dealers are sleazy

Yet more proof that, in general, card dealers are amony the sleaziest of business people.  While what they did is not illegal, it certainly is unethical to say the least to take advantage of an inexperienced student.  Disgusting.

 Next time please try to find someone - maybe someone at school? - who understands their disgusting ways.

There are good honest dealers but I think they are few and far between.

You know who would have helped you out?? A mechanic before you bought the thing. There is nothing shady about "as is", it is very, very common. I have never bought a used car without having a mechanic look at it no matter how "clean" it looked, and I knew this when I was a teen-ager.  It takes more time and money but completely worth it. There is no ripp-off, this is common knowledge.

Kool Kars, Inc (koolkarsflorida.com) of Ft. Lauderdale , FL responds:

The young man who purchased the car told the truth in parts of his posting. He did buy the car from us. It was as he stated: sold AS IS with no warranty.  The vehicle was a 2003 Hyundai and the price was somewhat over $4,000.00

We assume that he is telling the truth that the vehicle broke down under the circumstances he discribed.

In his rant he states: "Their cars are sold AS IS, and that's a major red flag, but who was I to judge?"  Those are his words!   We display the AS IS on every car.  It is all over the purchase agreement.  It is not a red flag.  It is the terms of sale.

The rest of his posting is nothing but lies and slander.  The facts are the facts and do not support ANY of his complaint!!!   We conduct our business in accordance with all rules and with full disclosure. 

He has lied completely about the Sales Tax issue. He has lied that we profited from that money. The Florida Dept of Revenue has specific laws and regulations concerning sales tax collection. We were required under the law to collect the FLORIDA SALES TAX and we did. We reported that sales tax and paid it to the FLORIDA dept of revenue as required by law. The State of Florida and the State of NY do have a reciprocity agreement whereby any amount of tax that would be collected by NY, in excess of the amount collected in Florida , must be paid to NY when the vehicle is registered there. This can easily be verified by the Florida Dept of Revenue and the details as to the law can be found on the internet.

The price he paid was a fair price for the vehicle and was based on it being a used car with NO WARRANTY.  His problem is not that we did not fix his car. His problem is that he purchased a car without a warranty and when it broke he decided that it was our responsibility. 

Everyone knows that when you buy a used car without a warranty you are rolling the dice. He admits in his tirade that, in fact, he was offered an opportunity to purchase an extended service plan and chose not to do so! We have a crystal clear agreement that said in bold print: AS IS NO WARRANTY. He signed this and a similar AS IS statement at least 4 times.

The Florida Dept of Motor Vehicles rules are clear on this issue and that is why when he contacted them and the office of the State Attorney General he did not get the help he wanted.

Many of you who read his rant realize that he has said things about our staff and our business that are both untrue and designed to damage the reputation of the people and business. Buying a used car is simply taking a chance but it is not stupid but people who slander and libel are stupid!
