I sold a Gibson L-00 on Ebay to this person (ebay ID # 110140791766 ) for a total of 994.85 paid to my paypal account.

Guitar was shipped, received by the buyer ( Ted Szajer LA Guns ) and signed for.

Buyer reported that the guitar was unsatisfactory and that cracks were in the guitar that had been repaired and demanded 200 dollars from the seller.

Negotiations followed with the seller reminding the buyer that the original ebay listing had clearly stated that the guitar had cracks in the front and since the seller had no prior knowledge that the guitar was professionally repaired, the seller offered a full refund through the paypal refund process.

Buyer, through the paypal refund process had until 4 Aug 2007 ( one week ) to follow up on the claim and ship the guitar that had sold for 994.85 to the buyer. On the night of 4 Aug 2007, seller entered a UPS shipping number. Tracking information did not appear until the item was received by UPS on 10 Aug 2007 (six days)

Package arrived 12:14 pm on 17 Aug 2007

Opened package in the presence of Police, package contained one Epiphone FT-132 ( approx. value 50-110 dollars)

Seller contacted buyer, buyer refused to send correct guitar, paypal automatically refunded money to seller leaving the buyer out 994.85

Last report was written in the heat of a paypal dispute. Mr Szajer and La guns/ La guitars came through and all was okay. The company has a good reputation and aside from a couple of small court issues so does Mr Szajer. ( I had a private investigator friend in L.A. check up on both and can confirm that information )
Mr Szajer actually came out well in my mind in regards to this misunderstanding. Had I the ability to withdraw this complaint I certainly would have.
My apologies for jumping the gun on this one. At the time I thought that there was no end in sight in regards to the auction, and would be happy still to buy back the guitar in question for the price it was sold.
This was no more than an exchange of wills and a senseless pissing match that in the end earned my respect for mr Szajer and LA Guns.

First off, NONE of the companies above were involved in this transaction so I'm not sure why the names are mentioned. I did buy a Gibson guitar from eBay member equineart2003, which is an account registered to one Barbara in Greenbush, NY.

The ad said This is a really nice guitar, as you will see in the pictures. Plays and sounds as well as it looks. Action is low and nice. There two minor cracks in the finish on the front of the lower bout, below the bridge. I tried to get a picture of them, but it just wouldn't happen. It is a very cool guitar for blues and fingerpicking. I used it, but have a new resonator on the way and the lesser-used models of my extremely high-end fleet are reluctantly being auctioned off.

When asked if the finish cracks go through the wood, the seller wrote that the cracks do not go through the wood. This was an obvious lie as you will see.

To start with, I paid in full for the guitar the same day I bought it, but the guitar was not shipped for 30-days, during which time my emails went unanswered. I got Barbara's number from eBay but my calls were ignored as well. Once I did get the guitar, I was very disappointed. The guitar was grossly misrepresented by the seller. It was riddled with repaired cracks throughout the top, and the cleats could clearly be seen from any angle. I got a hold of Barbara but she told me to contact her friend Erik Erk who is the owner of the guitar. She gave me his phone number (518) 605-6905 so I called and left several messages that went unanswered.

After calling Barbara again I was finally able to get a hold of Mr. E--- but I got only double talk so I cut off communications and filed a Paypal dispute. Paypal disputes are a miserable thing to have to go through, but when you spend as much as I do on guitars you will run in to some dishonest sellers and sometimes it's unavoidable.

Once Eric got the Paypal dispute he was more willing to talk and told me to ship the guitar back for a full refund less shipping. I figured I rather eat the $100 shipping fee than get stuck with this guitar, and had the guitar sent back to him. Long story short it seems Mr. Erkin got real lucky due to a shipping error, and ended up getting paid the full price $950 for the misrepresented Gibson that was worth $500 at best.

As you can see, this had nothing to do with any company, it was two guys and a guitar sold on eBay. And the victim was me.
