Since they had my review removed I will do my best to draw a picture to everyone how shady this escrow company is. I can image how many other reviews they have had removed.

 

In mid April I made an offer on a house in Granada Hills. It was being sold by an offer agent named John Mazziotta (who I have already reviewed) mid April of 2017 I entered escrow for home purchase in Granada Hills, CA. The sellers agent was good friends with a unprofessional associate at Landmark Escrow named Victor. Victor was suppose to open escrow the day following the acceptance of our offer, yet him and John decided to hold of. This in turn delayed me getting an escrow number and documents for me to begin my loan. After about a week of hassling them to simply open escrow, we received escrow instructions on a Friday at 4:52PM. Once I had started my loan it was already almost two weeks after the acceptance of the offer. (The documents from escrow didn't arrived until a week after that) Once I had everything finally handled, It was almost 3 weeks since I had my offer accepted. This gave the awful real estate agent John the idea to send me a removal of contingency. This whole move by John and Victor was done on purpose to take my deposit. They gave me limited time to complete my loan, yet kept pressuring me to remove contingencies. Victor began sending cancellation notices, and threatening to cancel escrow. (keep in mind escrow is not suppose to be one sided. It is paid by both parties, and both parties must be represented. Yet Landmark escrow was in bed with John and Remax and refused to listen or help. To make matters worse, Kim stopped answering my phone calls and stopped working with my loan officer to complete my loan. Akira Cisneros who was answering my phone calls started calling herself "Adela" in an attempt to hide her identity.

 

All in all, this is a awful escrow company to deal with, they will side with the people the know and refuse to help you, even if it means they have to run an illegal operation. They will fraudulent misrepresent you. They will work on behalf of the agent instead of being helpful. 

 

Victor, Kim and Akira will never change and they will remain immoral and unprofessional. For that reason I will be sure to tell all agents and customers to stay away from them. They will do their best to remove yelp reviews, hide their bad customer service skills and unethical tactics.

There are too many misstatements in this review to try and address all of them in one statement but we will do our best to paint a more accurate picture than the previous client made instead of hurling accusations and incorrect information.  The client who is trying to maliciously make so many misstatements is doing so as a complaint he has with an agent who represented the seller and not necessarily with the escrow company but is blaming everyone else and anyone else. 

 To clear up the timeline of events as well as the non performance of the client making these accusations let me highlight a few FACTS:

 Complaint was that escrow was to open the day after acceptance. 

*****Fact is that the buyer and his agent failed to contact escrow holder to actually open the transaction or provide the accepted Contract and or counter Offer which was signed and accepted on April 13.  These items were provided to escrow holder on April 20 at 8:57 p.m. (AFTER HOURS) by the listing agent.   Escrow then acknowledged the opening of the new transaction on Friday April 21 at 10:27 a.m. and provided the Buyers agent an escrow # and wire instructions for the opening deposit.  Additionally the opening packages were sent to the Buyers agent at 3:58 p.m. on same day of April 21.  For the fact that any escrow company had received an accepted offer and be able to generate an opening package to all parties in less than 24 hours is extremely professional and exceptional.  This client SHOULD have just left the review as a Thank you for a job well done!!!.  The buyer and his agent reached out to the escrow company a total of 0….let me rephrase….ZERO times in order to notify us of an actual signed contract or request for any items during this period of time. 

*****Additional fun fact ….the Buyers opening deposit is contractually to be delivered to escrow holder within 3 business days.  While escrow holder is being accused of delays and holding off why did the buyer of this complaint fail to deliver a deposit until 4-21-17 and only upon our request for it.  In this regard the Buyer and their agent failed in their responsibilities and looking to blame other parties for their error.

 

Complaint from the client was a statement made by them personally which read “ Once I started my loan it was already almost two weeks after the acceptance of the offer” …..this statement was made by the client admitting they delayed themselves from working out the financing details of the loan for 2 weeks but now would like to point the finger at others. 

*****Fact is that escrow was notified of the buyers selection of lender on April 28 and Landmark Escrow in turn supplied the requesting lender the opening package by 11:28 a.m.  Again please note the time delivery of the request as well as the prompt response and provided documents.  Additionally in this industry the lenders typically always ask for fees upfront so that they may disclose their Loan estimate and accurate disclosures within 24 hours of acceptance as a standard practice .  This situation never had any request made to Landmark Escrow until the date of April 28. 

 

Complaint was that Victor ( an employee of Landmark Escrow) conspired to cancel escrow and take the clients deposit. 

*****Fact is that escrow holder does not create instructions without first receiving instructions from the principals to the transactions or the agents acting on the principals behalf.  In this case the seller and the listing agent notified the buyer that they were passed their contingency period.  The listing agent and seller tried to negotiate for an extension of the contingency period but the buyer declined and therefore the seller instructed Landmark Escrow to issue out cancellation instructions.  Additionally the cancellation instructions were sent returning the FULL deposit to the buyer.  There was NO attempt by the seller to retain any liquidated damages as well as no attempt for Landmark Escrow to charge any cancellation fees.  The cancellation instructions were issued ….all parties signed ….and the buyer ( complaint maker of this review) who failed to abide by the contractual time frames and obligations received their FULL DEPOSIT back once the instructions were fully executed and provided to Landmark Escrow. 

 

Complaint was made that Akira was pretending to be Adela . 

***** Fact is that we have two separate employees …one named Akira and one named Adela.  These are not the same person as complaint is indicating and alleging.  These two employees work on two different teams and Adela has nothing to do with this file but may have been handling the overflow of calls coming into the escrow company on this particular day. 

 

**In closing …… Please note for any other reviewers who may read this rebuttal and clarification issued by Landmark Escrow who is falsely being accused in these statements…….  While Landmark Escrow works effortlessly for all parties to provide items in a timely fashion our normal turnaround times are 24-48 hours.  This situation exceeded that of standard practice and that of other escrow companies in the industry as well.     Thank you for your time in reading this and I wish everyone a blessed day.
