Wow what a day! This is the second company this week trying to get money from a discharged bankruptcy debt. Lease Financial Group put on my credit report that I owe a debt that was discharged in bankruptcy court in August of '06. Is this the new trend for these bottom dwellers? The other company was The Sherman Companies aka Resurgent Capital Services, PYOD LLC. Please read my ripoff report on them. Thanks DMK

If they are attempting to collect the debt on a Discharged Debt they are in violation of US Bankruptcy Code. Send in a Dispute to your credit reports stating it was a discharged debt. They will then remove it. At the same time send a Certified Letter with Return Receipt to these companies stating that it is a Discharged Debt and attempting to collect on it is a Violation of US Bankruptcy Code
11 USC Section 524 - "Effect of Discharge"
The Bankruptcy Code has more "teeth" to it than the FDCPA and FCRA does. You should inform the attorney who handled your case and let them know. You may have very good cause to file a suit against this company.
The only thing that could have effected the discharge on these debts is if at anytime you reaffirmed the debt. If they have a signed reaffirmation agreement you have lost any protections against that debt that Bankruptcy would have provided.
This would also be a good time to review the rest of your credit report(if you haven't already) to verify that everything else is being reported as it should.
