When I made an appointement with this bankruptcy firm I waited for over 5 hours pass my appointment and was told only one attorney had shown up.
During the appointment I paid a retainer and was told the filing would not be made until completely paid and that once paid it would take 3 week to file. I paid everything 2 months ago and go a letter a week ago saying it was going to take any 5 to 7 weeks.
I tried to call the attorney and never get a reply beyond the answering service. I have a number of small claims hearing comming up which I should have never had to be at and my pay will properly be garnished due to thier goofing off.

Noel,
First off let me state that I went to law school and worked for two years with a currrent associate in this firm. Very bright and professional guy. Last time I spoke with him he didn't seem entirely happy with his gig, but he didn't really have anything bad to say about the firm either.
Having you show up for an appointment when there wasn't an attorney available is certainly poor customer service. I hope that they were, at least, hugely apologetic about your wait.
As for them not filing the petition until their fee was paid in its entirety, this is not only commonplace, but a necessity in Chapter 7 cases. If the petition is filed before the lawyer is paid, the lawyer doesn't get paid. His right to collect the remainder of his fee goes out the window with all of your other debts.
However, I can't see why it would take them so long to file your petition unless your case is uncommonly difficult for some reason. They use software that enables them to complete the petition and all accompanying documents, in most cases, in less than two hours. The software even files all of the paperwork with the court AND remits the filing fee!
Are you sure that the letter you received stated that the case wouldn't be FILED for five to seven weeks, or did it state that the case wouldn't be COMPLETED for five to seven weeks (which is the average "filing-to-finish" time for a Chapter 7 case)?
Keep in mind that, even if you do have some small claims hearings coming up, it is unlikely that any of your funds will be garnished EVEN IF it takes five to seven weeks to file the petition.
And assuming that the petition is ultimately filed before too long, you don't really have to show up for any small claims hearings. You can sit back and take the default judgments, as they will be discharged in the bankruptcy proceeding anyways.
But I would recommend that you keep trying to get in touch with your attorney and figure out if "five to seven weeks" refers to the amount of time needed to file the petition or to complete the case. If it refers to petition completion time, I would want to know why it's taking so long.
