Hello Folks,

I purchased a used 1995 BMW M3 from Rt 6 Auto Sales via eBay. Lenny Curreri is the owner of the company. Payment was in full to Rt 6 Auto Sales via a Loan check. My lender is Capital One Auto Finance.

The ebay auction ended June 23, 2006. The auction was run by Scott Stanley of Rhode Island, ebay name "djsfast". The listing noted that the car had a clear/clean title. Carfax came up with the vehicle being titled, with no accidents.

After the check cleared, a bill of sale was given to me by Rt 6 Auto Sales, but no title. Lenny Curreri stated that cars 10 or more years old are not required to be titled in RI. An inquiry to RI DMV confirmed this, and my lender was fine with the Bill of Sale from a Licensed Dealership.

After waiting 7 weeks or so, Lenny Curreri still had not shipped the vehicle from RI. I flew out, picked up the car and drove it back (2400 miles!!)

I tried to registered and get a title in Idaho. Idaho Transportation Department refused to issue a Title with just a bill of sale. They required paperwork showing that Rt 6 Auto Sales owned the vehicle (i.e. paper trail of bill of sales or titles from last registered title).

Lenny Curreri, after a couple of months of my numerous calls and threats, provided me with a photo copy of a Massachusetts Certificate of Title issued to Valter M Armentano (aka Euro Auto Inc.) on 03/21/2003.

Lenny Curreri also provided an Assignment of Certificate of Title by Owner, transferring ownership from Mr. Armentano to a Christina Betters on 11/07/05.

As you can see there is no paperwork connecting Christina Betters to Rt 6 Auto Sales or Lenny Curreri. As far as Idaho is concerned, Lenny or Rt 6 Auto Sales did not own the vehicle nor were in a position to sell it to me.

Repeated calls and threats have yielded no additional paperwork from Lenny Curreri. All I need is a bill of sale connecting Christina Betters to Lenny or is company.

I'm currently filling out a complaint form to the Rhode Island Dealership Enforcement department.

My local contact with the Idaho Transportation Department (ITD), said that if I cannot get the necessary paperwork from the Seller, then I'll need to bond the vehicle for 1 1/2 times the value of the vehicle. She noted that the state of idaho requires that dealerships have a bond in case there are title issues such as I'm dealing with. I don't know if RI has the same requirement, but will be finding out soon.

There are other issues as well. The vehicle wasn't as described in the auction, alarm doesn't work, keyless entry doesn't work, power window problems, substantial exterior rust, etc. I'll deal with that later.

Any help or ideas of what to do would be greatly appreciated!

Same problem found all over rhode island

unfortunately this is common issue in rhode island. i've found myself victimized from a different end of a similar situation (see:Dan Shabo scammed me out of my vehicle.)

since my experience i have heard of that particular dealer selling at least two more vehicles without titles. no action has been taken against him. instead he actually seems to be profitting from it. his inventory has at least doubled since it happened to me.

there does not seem to be any legal foundation protecting consumers from scam artist dealers in rhode island. i have dealt with the state police who act sincere but end up blowing you off. you cannot deal directly with the atty general's office. the only thing that you can do and that an atty would advise you to do around here is exactly what you are doing.

however, it seems that the only thing that works is taking the problem into your own hands which is going to be difficult from 2400 miles away.

if it were possible, i'd willingly get involved in a class-action lawsuit against used dealers in the foster/chepachet area. unfortunately that's not feasible and i really wonder right now if the judges in rhode island are on the take as well.

sorry not to have been any help. hopefully the dealer commission takes away this guys license.
