We signed a payment deferment agreement. The company deposited the check four days prior to the agreed date with a resulting nsf fee to me. I brought them a cashier's check that was minus the fee I had to pay. They refused payment and referred it to their retrieval company.
The retrieval company and I came to an agreement and everything was settled. I thought. Two weeks later, Lithia instigated an ACHPAY without authorization then claimed they didn't do it even though my bank says it was them. Lithia referred me to their retrieval company who also denies knowledge of the transaction.
Somebody lied and stole money from my bank account. All in all they have cost me fuel for two four hour trips to settle this, two nsf fees, and now a fee that nobody claims stealing from my bank account.

After receiving communication from the state justice department, Lithia reimbursed the fees they charged. It would have been better if they had done this in the beginning like I had requested.

If you have the agreement in writing that stated they were going to hold off on depositing the check and proof from the bank that they didn't do that, then you have a very simple Small Claims Case. You can sue them for all of the fees they cost as well as the court costs it cost you to file the case.
