Maracay Realty - Maracay Homes Maracay Homes Suing buyers to buy homes if buyer must cancel contract - no exceptions Scottsdale Arizona

Signed a purchase contract with Maracay Homes at Stonefield, Dobson Road and in Chandler, in February 2008. Three times I was told, if I have to cancel contract, salesperson always stated that I would simply lose my $20,000 earnest deposit (which is 5% of the downpayment), and could walk away, including when I specifically asked this at contract signing.

August 2008 - wrote letter describing my concerns to VP of Sales. Never gave me the courtesy of a response.

OCT 2008 - Circumstances changed greatly due to downsize with the company and have been told mid of Dec/08 or Jan/09 will be my last working days with the company. Try to find a new job in this market is a night mare.

Oct/26/2008 I told them in writing that I do not want to move fwd with this home and can't afford anymore.

They informed me they would sue me if I did not buy the house, via email and letter; contract says they have option to take legal action, but never mentioned or pointed this out like they did paragraph about loss of earnest money if contract canceled.


I don't even know where I will be getting my next paycheck after Dec/08 and with increasing health cost I am paying for three of us from my pocket. Most LIkeley I have to find something outside of AZ, probably a short contract for now as most company are in downsize phase.

Buyers beware - be sure at the end of an 8 month build period you won't have to cancel for any reason like moving or not selling home, or this builder will force you to buy or sue you.
