 Maryanns miracle cars in Davie Florida and her payment/finance company Automotive capital resources are in the business of illegally collecting debts. 

i purchased what seemed to be a decent running car from this dealership but it turned out to a be a lemon and needed.over$2000 in repairs in less than a year of owning it. i tried to compromise and ask if there was anyway i could transfer my loan to another vehicle and they said no. i told them due to all the repaurs i was late on 2 payments but nit consecutuvely and i owned the car for almost a year..but after being1 day late on the 2nd payment they started harrassing and threatening phone calls and i quote "something bad will happen to you if you dont pay".  they also contacted other people i had listed as references and used threatening measures also

Do not buy a car from this lady or used this finance company

I actually did attempt to refinance my loan which is why i was offered the new car loan instead and i accepted it. Also if you do some further research you will find that there are other complaints against ACR and Mary Anns, maybe not as honest as mine but once again as a consumer im just recounting my accounts of dealing with these companies. I am quite aware this maybe an isolated incident and the need to collect was out of desperation and all legality was thrown away. 

As the person actually involved in the situation I am the one who knows what was said and what was done so there is no amount of research you can do to dispute that. In this case wrong is wrong and what was said was indeed wrong. I stand by my statements and will make it known to anyone that asks about my experience. As you noted in my original post yes i signed a contract and yes I was late on 2payments in a years time so I owned up to my part. I am quite sure that neither ACR or Mary Anns  will admit to threatening or harassing phone calls due to implications it could bring.

I suppose that someone like yourself who has a stellar credit rating and has probably never been late or missed any payments or has never been contacted by a creditor except to say what a great customer you are wouldnt understand the tactics some companies use to collect a debt. You also made mention in your first post that you are not employed by either of these companies but your rebuttals seem quite personal almost like you feel im attacking you.

Im only detailing my experience and unless you are me you cant dispute what actually happened. I know the truth and i stand by my statements. I also want to encourage other consumers to think twice before using these companies. You may continue to rebutt these statements but i know the truth of what because it happened to me but I wont say anything else on the matter.

The primary focus of your initial report was the car you bought required repairs within a year.  Additionally, you were late twice during this time and they made collection calls.  During those collections calls, at first you claim they said "something bad was going to happen" if you didn't pay.  You also stated they contacted references. 

Upon my own research, I've discovered the finance company on the deal, Automotive Capital Resources is a multi-state company which has been in business for five years and is a subprime lender.  The dealer on the other hand has been in business 17 years. 

As a result of your initial report being properly rebutted point-by-point, you now offer a new version of this alleged matter. 

1.  As a subprime lender, (ACR), as is typical of such a lender, their APR is three to five times the APR of a bank loan.  You say you have experience with bank auto loans.  As such, it would have been easy for you to note the magnitude of the APR with ACR as compared to your stated bank history. Rather than declining that offer and coming back with a pre-approval from a bank with a low APR, you apparently accepted that much higher APR out of the goodness of your heart because you felt generous that day.  Then you go on to say, you made no attempt to refinance that loan, which you could have done with your stellar credit score.

2.  The thrust of your initial report was complaining about their collections efforts which included the contacting of your references.  With your self admitted stellar credit record, a reasonable person would have been very concerned about a late payment and would have kept in touch with the lender rather than having them contact references which subprime lenders will do when the borrower fails to stay in touch.

3.  The complaining you've done in your report can be summarized to be within two areas...mechanical problems one year after purchase and their attempts to contact you as per regular collections efforts.  Now suddenly you were saying they threatened bodily harm!  ACR has existed 5 years.  If they threatened others with bodily harm, surely others would have experienced it as well and legal action would have been taken.  None of that has happened as they still have a five year track record.  Additionally, the dealer, with their 17 years of experience would have ditched them long ago.  However, if your concern was over this alleged threat of physical violence, then quite obviously that aspect of your complaint would have been front and center of your initial report. It is not and was only offered in a changed account of your story.  Any reasonable person, if there were actual physical threats would have been on the phone the minute after the threat was issued...on the phone to the police as per possible terroristic threat charges.

In summation, I offer my original rebuttal as it stands.

still illegal and junk cars

regardless of late payments and signed contracts it is illegal to harass and make threats against anyone who owes a debt which is the biggest issue that I have...the next time someone calls and threatens your family members with bodily harm then you let me know how you feel about the situation. And not that its any of your business i bought the car from this dealership bc i liked the vehicle not bc i couldnt get financed anywhere else. And i did ask if i could get the loan transferred to another vehicle that was not a lemon. I currently do own another vehicle that was financed thru a.bank with a lower interest rate and payment. However as a consumer i do have the right to inform the public about the illegal tactics used to collect a debt.

By your own admission, YOU failed to live up to the contract YOU signed.  YOU failed to make YOUR payments on time.  By doing so, YOU "turned on" the collections efforts.  Umm, what exactly did you expect them to do?  You are doing business with them because you couldn't get financed by a bank with a lower interest rate and better selection of cars.  YOU got yourself into that situation by not paying previous creditors on time, or at all.  Whether or not there's problems with the car is NOT the issue here so don't attempt to use that as a smokescreen.  When you sign a contract, you agree to make all the payments on time.  YOU failed to do that.  No ripoff here and by the way, don't bother to hint or claim I work for them, because I don't!
