Mattresses and More Lied about condition of the Mattress sold used as new Lilburn, Georgia

 On 6/20/11 my husband and I went to purchase a new mattress and Mattresses and More in Lilburn, Ga. The salesman told us that the mattresses are discontinued models from the Sealy Manufacturer in Conyers, Ga and that they buy them by the truckload. We were also told that there is a year warranty on it. We specifically asked if these mattresses had been slept on or in hotels, returned, defective or used because I have heard of bad deals like that and he assured me that they were direct from the factory and nothing like that had happened.
 
I also said we wanted to be careful since there has been a problem with bedbugs. I chose the mattress and paid 525.00 cash. He suggested new box springs also to protect my investment, I found and did buy a pair of brand box springs from an individual. Mattress started sinking on both sides and humping up in the middle, very defective wear pattern and we went back 8/14/11.

Alan Jr. took pictures of the mattress 8/17/11 On 8/19/11 received a call from his partner who told me he wouldn't be able to do anything with the mattress due to the dog hair, stains and smells. I went home and inspected the mattress, there are a couple of light stains. I looked closely at the tag and it has stamped on it Second Hand No Warranty in red on the back of it stains are most likey from former owner, I have been tricked and lied to about the condition of this mattress.

Seller is fully aware that I did not want a used mattress and he knew I would not buy it if I had any idea that the mattress was anything but new, it was wrapped in hard plastic and I was unable to read the tag at the time of purchase.  It is illegal to misrepresent a mattress as new in the State of Georgia.

BBB and Gov's Ofc of Consumer affairs have had reports filed and they have done NOTHING to help me.  The Co replied to the complaints with an offer to SELL me another mattress at a great discount and that was good enough for these "consumer advocates" nothing was ever resolved and we had to spend 227.00 on a mattress topper just to be able to sleep on this used piece of crap.  Do not spend your hard earned money with these crooks, they fully knew they were selling defective mattresses and once they got my money l was screwed.  I really have a hard time believing that this practice is "ok" in the state of Ga. but apparently they have been getting away with this behavior for years and years.
