I have found that in dealing with pay shortages at MeasureComp from the district manager all the way to the top of the company that I continuously get the run around. When I can't solve a problem with the district manager I have gone over his head to the payroll department and to Jim Chrylser only to have the problem refered back to the district manager with no solution available.

The problems I have run into are:
Not being paid for parking
Not being paid for hard surface measures
Not being paid for not at homes
Not being paid for extra rooms
Not being paid trip charges
Not being paid for training new techs
Not being paid for having to go check other techs measures
Not being paid for jobs that were called and added onto the route and had to be manually put into the computer while on the road
Being charged back on jobs that shouldn't have been charged back(still checking to see if their charge back system is even legal)
Not being paid for extra large jobs

I also inquired about being paid for the time that it takes to do the am and pm reports,putting a route together and calling customers, which in my case takes about 2 1/2 hours a day and was told that the amount of time it took to do this wasn't worth being paid for.I also inquired about being paid for the time that it took to transfer drawings from paper to the computer when there was a malfunction and could not finish the route using the computer and was told they wouldn't pay twice for same measure.

When I first hired on with MeasureComp I was told that the average for a tech would be 75 miles,vaction pay would be figured by dividing the prior years gross pay by the number of weeks worked to determine a vaction pay.Of course none of this turned out to be true.

In trying to resolve these issues I have been told things like:
You don't get paid for that
They did away with that pay program
I'll check into it and get back to you which they never did
Your right you should have been paid for that but they won't go retroactive on paying it and that I should consider it a raise because I'll get paid for it in the future which I didn't.

I have asked for a copy of charge backs since they are tax deduction and have yet to recieve a single copy. I have also asked Jim Chrysler to go over my charge backs because of charge backs that I felt should not have been,again it was refered back to the district manager, again nothing happened.

I don't know if the delaying tactics are because HomeDepot is suppose to be buying MeasureComp and if that happens does it allow MeasureComp off the hook for back pay. I do know for sure that HomeDepot already owns the rights to MeasureComps drawing program.

Hi John--

I will assume that you are the same John that is the named plaintiff representing the class of MeasureComp employees in the notice of a possible collective action against MeasureComp alleging possible FLSA violations that that we got the other day.

Thank you for initiating this action. My husband is an ex MeasureComp employee from Market 11 (MD/DC/VA/sometimes DE). I have kept detailed records of his time and travel, especially during the times of Home Depot special sales and "free measures", and other times when he was working in excess of 70-80 hours/week, driving crazy mileage and/or otherwise being required by his immediate managers to meet unreasonable demands with respect to time and money spent in order to keep a job which sometimes cost more a week than the paycheck he received at the end of it. MeasureComp has always played fast and loose with the FLSA specifically with regard to hours and overtime, and I'm truly glad that someone is finally standing up and saying so.

We will look forward to working with you and to providing documentation to support this case.

Still Fighting

Hope everything is going well for everyone else involved with MeasureComp.Sorry I have not responded sooner but health issues have kept me out of the loop.

At this time I have filed a lawsuit (class Action) against Measurecomp.As of this writing they have until the end of Nov 2007 to respond.Suit is for Federal Labor Laws they have broken on non payment of overtime hours,reclassification of wages.etc.Lawsuit was filed in Cleveland Federal court.

Part of the lawsuit requests that all current and former employees be notified by MeasureComp of the pending lawsuit with instructions on how to join it if they wish. I'm not 100% sure how this will work from state to state but I will keep you posted and if for some reason people from other states cannot join the suit in Ohio you might get enough information to start your own suits in your states.

Keep your fingers crossed and I will let you know what happens.

my first clue shoulda been when while in training, we got 100 a day, i got offered a trip charge of 75 to go to a far cust, guess what? the 75 came out of the hundred. i never got the three foot level, and i dropped the comp and had to pay for it. man, i could travel 250 miles 6 counties, and 2 states in one day. loved the job HATED the company--and depot

If you want to pursue, I would like our legal advisor to be aware of your situation too. Contact this site for my information since I can't post it and post a new rebuttal indicating so. Its a start.

Also, it is important that you file your own rip-off report on this matter. More and more individuals will respond as we have. Strength is in numbers.It is only a matter of time and MeasureComp will deal with there unfair actions.

If you know of other individuals or have a means of contacting current or ex-employees, it would be highly recommended that you do so and add them to your labor claim as they surface (be sure to tell them about the site). It's a bit of paperwork but you may have better luck then us in NY/NJ Market in labor court. We here are taking further action against MeasureComp.

The exact same thing is happening to us here in California except we recieve no compensation for milage and other minor differences. We contacted the labor board and found that this may be illeagal. We also have experienced the run around and avoidance. If there is any information or suggestions about what we should do please notify us as soon as possible. Fresno, Ca Thank you, Brandon

John,

All of your issues are just as is here in the NY/NJ Market. It appears that the encountered issues are part of MeasureComp standard policies that they don't reveal at the time of the orientation. That would explain the high turnover since most individuals will lose patience fast with corporates run around & lack of assistance.

You are correct in that all time devoted to work (the AM/PM reports, call time, routing and transfer of diagrams etc.) is payable work time that MeasureComp is responsible for compensating for but doesn't. Contact me and I can give you more information on that off this site.

I give Rip-off Reports the authorization to pass on my contact information to John in Cleveland Ohio.

John, since the current issues are not restricted to one state, that gives us better opportunities for filing a larger case as more information and individuals unsurface.
