Because of his poor business practices and acounting, he has owed myself and others for past labor payments. Not only has he not payed but he payed me twice with NFS checks. They were deposited in my account and recieved many fees totaling over $900.00, before I was informed by my bank. He has written numerous bad checks in the past to others. He should not be hired as a contractor from this day forward, for these actions. This has been very stessful on my family and the housing company he did work for. I currently have four property liens on work I completed, but see no relief from this action. So, while I fall behind (tough job market) with bills, he skates on his responsablity to make payments. I will see to it he never works in the painting trade again. We don't need low-life individuals in this trade, or working on "your" home. Yes, I am at the end of my rope. Nothing like going backwards.

First I need to know is he a legitimate employer who takes out taxes, matches SS, and provides workmans comp and unemployment insurance? Or are you paid illegally or "under the table"?
1. File a wage claim against him with your local wage and hour division of the Dept. of Labor. After you do this he will also get nailed for any other compliance issues like not withholding taxes, or providing workmans comp, unemployment, etc..
2. File a case in small claims court for bad checks and all associated fees, etc. You will certainly win and get a judgement if you have your documentation. Once you win and get a judgement, file liens on all of his equipment, his cars, his home, etc..
3. Take the bad checks to your local District Attorney's office for CRIMINAL prosecution. Every state is different, but usually after $50-$250, it becomes a felony.
4. Do you have his cell phone#? Call him every 15 minutes throughout the business day to ask for your money. Then call him about midnight and again about 2 AM.
There are so many ways to deal with dirtbags like this, but it is up to you to actually follow through to get your money.

I forgot to say, checks total $2100 plus fees! If anyone needs a talented,honest,drug free painter/paperhanger, I am looking for work.
