BUYER BEWARE:

This report is to warn any potential Grand Rapids, Michigan area foam insulation customers that Michigan Spray Foam LLC is a dishonest contractor.

Michigan Spray Foam LLC entered into an agreement with an outside salesman to act as its sub-contractor and agreed to pay the salesman a commission for each job that he sold for Michigan Spray Foam LLC.

Without notice, Michigan Spray Foam LLC has decided to stop paying its salesman for jobs which he sold for Michigan Spray Foam LLC.  The salesman has attempted to reach the owner via email, text-message, and USPS mail, but Michigan Spray Foam LLC has ignored the saleman's
communications.  The salesman is now in the process of filing liens against the properties which he hasn't been paid his earned commissions.

Michigan Spray Foam LLC has also attempted to circumvent the contracted salesman by contacting a number of the salesman's customers to try to cut the salesman out of the transactions.

If you are considering having Michigan Spray Foam LLC do any work on your home, barn, or business, you should be aware that the company  has established a pattern of not paying its obligations to its sub-contractors, and / or suppliers and / or vendors, and consequently you may end up having liens filed against your property.  Those liens will only be removed once either you, or Michigan Spray Foam LLC, satisfies the liens by paying the sub-contractors, and / or suppliers, and / or vendors.

Michigan Spray Foam LLC Refuses to Pay Sub-Contractor After Sub Provides NOTICE OF FURNISHING to Owners and Hiring Contractor

TRANSACTING BUSINESS WITH MICHIGAN SPRAY FOAM LLC:

Several weeks have passed since our first complaint report describing Michigan Spray Foam LLC's dishonest business practices.

This report shall serve to provide the reader with a narrative regarding conducting business with Michigan Spray Foam LLC and expose some of their dishonest business practices.

This report concerns the hiring of Michigan Spray Foam LLC by the owner(s) of a property located at 6708 Sunfish Lake Avenue NE, Rockford, Michigan 49341, through measuring and estimating services provided by the above-mentioned sub-contractor.  The sub provided the owner(s) with four proposals to insulate his pole building.  

After several months, the owner(s) contacted the sub0contractor to let him know that they had chosen one of his proposals and wanted to get the job scheduled with Michigan Spray Foam LLC.  The sub contacted the owner(s) the following day to request a copy of the signed proposal be emailed to him.  At that time, the owner(s) informed the sub that the owner of Michigan Spray Foam LLC had stopped by the property to pick up the signed agreement and deposit check, and that the job had been scheduled to be installed on April 16, 2018.

The sub-contractor sent the owner of Michigan Spray Foam LLC a text-message, thanking him for picking up the signed agreement and deposit, and for scheduling the installation with the property owner(s).

On the morning of April 16th, the sub-contractor sent the property owner(s) a text-message to confirm that the installation was still scheduled for that day.  The property owner(s) informed the sub that the installation had been changed to April 20th.

On the evening of April 19th, the sub-contractor sent the proeprty owner(s) a text-message to confirm that the installation was still scheduled for April 20th.  The property owner(s) confirmed that the installation was still scheduled for the following day.

On the morning of April 20th, the sub-contractor drove 96 miles (one way) to check on the installation of the job.  The sub arrived at the job site at approximately 09:30 A.M.  Michigan Spray Foam LLC didn't arrive at the job site until approximately 10:45 A.M. and 11:00 A.M.  The sub took photographs of Michigan Spray Foam LLC's pickup truck and spray rig trailer once they job had commenced and then left the job site.

The sub-contractor contacted the property owner(s) by text message at approximately 08:00 PM on April 20th, to ask whether they were happy with the job.  The property owner replied that they were happy.

The sub-contractor asked the property owner(s) if they had paid Michigan Spray Foam LLC in full, and the owner(s) stated that they had.

The sub-contractor emailed his invoice to Michigan Spray Foam LLC on April 22nd.  Michigan Spray Foam LLC did not respond to the sub's emailed invoice.  The sub contacted Michigan Spray Foam LLC via text-message on April 24th and again on April 28th, requesting information about receiving his payment.  Michigan Spray Foam LLC did not respond to the sub's text-messages.

The sub-contractor mailed a DEMAND package to Michigan Spray Foam LLC on May 2, 2018, demanding payment of the unpaid invoice for services provided.  Michigan Spray Foam LLC did not respond to the DEMAND package.

On May 16, 2018, the sub-contractor visited the property of property owner(s).  The sub found the owner(s) working inside the aforementioned pole building and asked the owner(s) if it would be okay to do a quick quality control inspection and take photographs of the installed job before the owner(s) closed the wall cavities and ceiling.  The owner(s) provided permission and the sub completed a thorough visual inspection and took photographs.  When completed, the sub asked the owner(s) if they would mind signing a PHOTO RELEASE FORM which would allow the sub to use the photos "in publications, news releases, online, and in other communications related to the analysis of contracted work completed".  The property owner signed the form.

The sub-contractor asked the property owner(s) if he minded speaking with another potential foam insulation customer about his experience with Michigan Spray Foam LLC, and explain why he chose Close Cell Spray Foam insulation, as opposed to any other form of insulation.  The owner(s) stated that he would be happy to do so, so the sub invited a man who we will identify as "Mr. A" in this report to come into the barn to speak with the owner(s).

After the two had completed their discussion, the sub-contractor told the property owner(s) that Michigan Spray Foam LLC had not paid the sub's invoice for services yet.  At that time the owner(s) replied that Michigan Spray Foam LLC's owner "told me that he wasn't working with you any more" and that he and Michigan Spray Foam LLC's owner had decided to draft another agreement allowing the property owner(s) to schedule the installation with a smaller deposit than the customary 50% deposit.  The property owner made this statement in the presence of Mr. A.

The sub-contractor and Mr. A left the property at that time.

In our upcoming report updates, we will provide the reader with a narrative describing the sub-contractor's continued attempts to receive payment for services provided to Michigan Spray Foam LLC, and the lawful process he is using to secure his financial interest in the improved real property. 

The reader should be aware that, in Michigan, an unpaid subcontractor has the right to secure his financial interest by recording a CLAIM OF LIEN against the improved property.  If the sub-contractor's claim goes unpaid, he has the right to initiate a foreclosure proceeding to force the sale of the subject property to satisfy his lien.  Of course, NO ONE wants this to end up in a foreclosure...
