#3 Consumer Suggestion

Don't waste your time or others with any "petition"!

AUTHOR: Steve - (U.S.A.)

POSTED: Monday, October 25, 2010

Take my advice here. Don't waste your time or money on a petition. It will go nowhere. There is no provision in the law for anyone to shut down a business with a petition.

If they are in violation of ethics, file the FTC complaint, and the appropriate FDCPA and/or FCRA lawsuits. If there are licensing violations, report those to the appropriate authorities. Forget the petition. Just a waste of evryone's time, that will get you nothing.

Detail?

AUTHOR: Robert - (U.S.A.)

POSTED: Wednesday, June 23, 2010

There is not much detail but the most important thing you can do is SHOW UP in court, as well as make sure that you file any required paperwork by the deadlines.  Because if you don't the could get a default judgment against you.

In court they need to be able to show that it is your debt.  They also need to show that it is still within the Statute of Limitations.  The SOL is a period of time that a company can file a suit against you.  If it is outside of the SOL you can use that as a defense and have the case dismissed.  Depending on the state and type of debt the SOL is usually 3-6 years from the date of the last activity(payment).

If you know it is your debt, the amount they are suing for is what you owe, and it is within the Statute of Limitations there is not much you can do other than let the judge decide and probably have a judgment entered against you or try to work out a deal with them.  But if you do make a deal, be sure it is in writing.  Also, if you do this before your court date and they say you don't have to go to court..still GO TO COURT.  Because some collection agencies are famous for telling you that everything is taken care of, only to go to court and have a default judgment entered against you.
