Last year our mortgage got sold to Midland mortgage and it has been a nightmare ever since. They incorrectly reported that we did not pay our mortgage during 2 months. This is false and I have tried fighting it through the company (I have called multiple times to speak to customer service and they are rude and not willing to help at all), I have reported to BBB, and my next step is to fight through the credit bureau.

I have proof that I paid my mortgage those 2 months, but they are unwilling to reverse the discrepancy.  I have never in my life written a bad review about a company, but this will be the first time. I have never encountered a worse company in my life. They are rude and commiting fraudulent acts. They are taking advantage of people with their power.

Although we have an extremely low interest rate, we will be refinancing just so we no longer have to be with this horrible company. I would recommend you do not give them a single dime of your money, they will somehow screw you over like they have MANY other people. You can find many reviews on the internet about this.

If you are being 100% honest, have WRITTEN PROOF that they received the payments on-time then you may have legal recourse.

The Fair Credit Reporting Act (FCRA) requires that a Creditor Report accurate infomation. It also allows you to dispute any item and if they posted incorrect information they are bound by law and regulation to remove it. If they fail to do this they can be subject to Statutory and Punitive damages.

So you need to get your "proof" of YOUR situation together, what other people say about them doesn't mean a thing for your situation.

1. Any written proof that they received the required payment before it would be 30 days late. Note if you were late and failed to pay a late fee, then you could be reported as late for failing to pay the total amount due.

2. You will need to give them the opportunity to "fix" the issue and need proof that you gave them this chance. A Phone call doesn't do it, and calling the BBB would be just a waste of time. You need to send them a Certified letter with Return Receipt to show when they received it. They then have 30 days to have the report fixed.

3. If they fail to fix it, do the same thing to each Credit Reporting Agency. They again have 30 days to remove it.

If at the end of this time they have failed to remove it you can then go after them for violations of the FCRA. The FCRA allows for a Statutory penalty of up to $1000 per violation. So if they reported it to the 3 credit agenices, you can go after them for up to $3,000.  If you have other real damages because of this you can go after them for this. You may also be able to go after each of the Credit Reporting Agencies individually for the Statutory Damages.

You can do this in Small Claims without an attorney, but getting a short consultation with an attorney may be a good move to make sure you are pointed in the right direction.

 You could have provided an intelligent point-by-point rebuttal; you could have written back more details of this alleged wrong doing but no, it's the same old tired, worn out, immature "you must work for them" garbage because YOU KNOW you have ZERO rebuttal!

Now why not write back how you didn't ask for my opinion? The FACTS with lender complaints are: when you pay on time, there are no problems and the ONLY complainers are the deadbeats and of course, it's always the fault of the lender!

We've all seen it here hundreds of times! Right, sure! Out of the clear blue sky they decided to pick on you!

 Yes, I will absolutely pay more money to get away from this awful company and not have to give them more of my money. I am definitely not the first person to say/do that with this company.

You can search other reviews with other websites. I have never in my life written a negative review for a company until today. So clearly there is a reason.

 Let's see here...they had nothing to do so they decided to just pick you and lie to the credit bureau, right? For no reason, they reported you late and in turn, you are willing to pay more interest and lots more money. What's the REAL story here?
