Hi! 

First, I should point out that I am a woman and usually my husband has taken my car to get tires but was unable to at this time.  So anyway, IGot a set of tires from them and they put the cheapest possible tires on (52.80 each) which = $211.20 and then charged me $201.79 for mount/balance of the 4 tires. ( mount/balance is an regular average of $15-$17.00 per tire at the time.  It took so long for them to put on the tires and I was in a hurry by the time they were done I hurridly paid the bill.  So a year and 8 mos. later when my mechanic informed me that I really  need new tires, I thought wow I just got these tires last year.

So I went home and found the reciept for the tires and noticed the tire only had 28,533 miles on them and the warranty for these cheap (and probably used when they put them on) is 40,000 miles.  So then I noticed the overcharge on the mount/balance and went in to the tire shop to get a refund (for just the overcharge of the mount/balance) I never even mentioned that the tires didn't even make it to the warranty. Talked to the owner and he laughed at me and said this is from last year! 

So he refused the refund and when I cont. to ask why he called some big samoan woman to escort me out.  When I left there I went straight to the Sherriffs office to see where I need to go file a complaint and a couple nearby heard my story and the husband said: oh Mike's Tire Man. Wow, I am supprised that place is still in business.  Anyway the sherriff office told me to file a civil suit and report to the various different agencies. Such as BBB, FTC and etc.  So, here I am, spending more time that I dont really have right now making sure this doesn't happen to anyone else. Thank you so much for all your help.

Perhaps I am a bit confused here.   But what does you being a woman have to do with this, and why must you specifically point it out as the very first sentence?  Are you saying you don't know how to read a receipt because you are a woman? Or are you saying that because you are a women they have to make an exception and give you your money back?

A company can charge what ever it wants.  The time to make a decision as to if that price is what you want to pay and it is for what you want to buy is BEFORE you agree to the service..not over a year and a half later.  The fact is that they provided you with the tires and installed them, they provided you with the receipt, and here is the big thing...you paid the receipt and didn't even bother to look at it for 20 months.

As you wer told, you can of course file a civil claim against them.  But unless you can some how prove that they didn't mount or balance the tires, or charged you more than what is in writing the judge is just going to throw their arms up and tell you to have a nice day before they dismiss the suit.

As for the warranty, thats what a warranty is for. If the tires did not last the entire length of the warranty than the warranty should cover at least a portion
of the replacement cost. If they are not abiding by the written warranty then you have a valid complaint. So you need to read the paperwork that came with the tires as to what the warranty includes. By the way, most warranties require you to prove proper maintence on them including rotating the tires. Depending on the car this is generally anywhere between once every 5,000 to 7,500 miles. If you can't prove that you may have your claim denied. But again ALL of that is in the written terms of the warranty.

The cost of the mounting and balancing is an overcharge only if it’s an amount greater than the estimate. Your dissatisfaction with the tires and the cost is a case of buyer’s remorse. There is no agency assistance or legal recourse for buyer’s remorse. If they sold you used tires without noting that on the invoice you would have a valid claim of fraud.

The intent of the advertisement was for you to enter your information into their registration system, not for you to win a Hyundai.  There is no Hyundai for you to win, either today or ever.  The $5 gift card was just a payoff to get your information, which will then be sold for a whole lot more than the $5 you got to whomever is in the market for your information.  That's how they make their money.  The dealer probably had very little to do with this except that Fatwin probably reserved one car for someone (who they may possibly know) to get a Hyundai, and possibly a kickback from the website.  This way, the contest is legal.  There is a winner, you do not have to be present to win, and an actual car is awarded.  The rest is just a gimmick.  It's not gambling either because the actual chance of you winning the car in this case, is zero.  They won though because now they have your information.

I suppose the only ripoff is now your information can now be sold and expect spam and other forms of junk mail coming to your house or inbox by people who will be looking to steal real money from you.  The way to avoid all of this is very simple:

  • Do not enter any contests.  You will not win

When you understand the point of things like this is for them to gather your information - and not a contest for you to win - you will be less of a target by real scammers who will try to steal real money from you.  Best of luck to you.
