I paid the individual $565.00 to record a demo CD and two months passed by, I spent 15 minutes or less at the studio so I asked for a refund. The individual claimed his credit cards were maxed out and that he had no money in his bank account to refund me.
Two more monthes pass by, I ask for a refund. He said that we'll finish the CD. I said I just wanted a refund. He told me he had no money. I told him I'd have to sue him. Then he sends me a rough draft song and a fake invoice stating that I paid $565.00 for one song. This isn't true. The full song isn't even recorded. So I'm suing him.

In reply to Osha Athletica's original complaint, I will start by correcting the untruths and provide actual facts found in the contract and correspondence with the client. * First, the client has reworded the original contract claiming that I agreed to complete "a demo CD” for the price of $565. The contract clearly states that I was hired for the demo recording of one song and I must add that this is a 'friends and family’ rate and my actual fee for a demo recording is $750 plus HST. * Next point is that only three months’ time has passed and this delivery time is not only satisfactory but requested by the client herself as found in 'Text from client on November 23rd 2017’. * 'Text to client February 1st 2018’ gives you an accurate description of the amount of time dedicated to this song demo. * Lastly, the only thing that is a "rough draft” regarding this song production is the scratch lead vocal that the client initially provided. A t the onset of this complaint, the client told me that any further contact would be considered harassment and I honoured this request as well as provided an instrumental mix of the production, so the client could re-record her vocal elsewhere. I have been delivering the same high-quality song productions to clients all over the world for 20 years and I have never had an unsatisfied client nor a request for a refund! The contract Delivered on Oct. 30 2017: To: Osha Athletica This document is an invoice and contract for the demo recording of one song with producer Peter Linseman. Recording, editing, mixing of TBD $500 HST = $65 Total = $565 Total Paid - $565 Text from client on November 23rd 2017: I think for the music I will just have to reschedule recording to February and March as December and January won't work for me. I'm sorry this just hasn't worked out the way I thought it would. Have a nice day. Text to client February 1st 2018: I must say I am disappointed and taken aback by your request. You are the type of person who places high value on agreements. Yet, I find that you do not honour your own agreements. I have worked several hours on your project, starting with reviewing songs, working on them, later being told to stop working on them, selecting a song, recording the rough vocal, and production work. Following your lead, I absolutely require the hours paid for at my rate of $50 / hour, and that doesn’t leave much left over. And the rate I gave you is already the discounted rate I give to close friends, and people I believe in, who may not be able to pay full price. This is business. We have a contract. We started the project under contract to deliver a finished demo, which I will fulfil. I will do my part. You have been treated more than fairly. Let's do what we need to do to fulfil your demo contract.
