I depositied a check for around $5700 and they would not release the funds even after it cleared the other account. They required me to fax over a picture of the check which I had to contact the issuing bank and the branch that I deposited it in. I was on the phone with them for over 4 hours today and they were treating me as if I were a criminal or something. I have never had to deal with anything like this before and it seems like they aren't used to getting checks deposited into their accounts.

This has caused me late fees and will probably affect my credit score because of this. They charge 25 per transaction for returned checks as well as the late fees for rent, credit card bills et.

I've had the account there since 2011 and used to deposit checks more than 15K at a time. I will definitely be closing this account and want everyone to know not to ever use this bank since they don't have normal practices. Hopefully you will be a real bank someday but now you're not.

Regulation CC

AUTHOR: Robert - (United States)

POSTED: Thursday, September 06, 2018

Regulation CC also known as the Expedited Funds Availability Act specifies when a bank must make funds from a check available. There are several factors that go into this including things such as the size of the check, how long you have had the account, the type of check and if you have had any recent overdrafts or returned checks.  The bank can also place an extended hold on the funds if they doubt the validity of the check.

Based on what you posted it sounds like they doubt the validity of the check. Since we don't know anything about the check their request sounds confusing. As if you deposited the check with them, they would have a copy of the check and wouldn't be asking you for it. If you did a mobile deposit by just taking a picture of the check, you shouldn't have needed to contact anyone to get a copy.

Hopefully you personally know who gave you the check and trust them. Because there are many scams out there that rely on this same regulation to get people to think funds have actually cleared only to find out the check was actually bad later on making them responsible for it.

Have they given a specific reason why they have put a hold on the check?
