These people are ruthless! I sent them a letter of validation and a few days letter i received this:

"We are in receipt of your communication dates August 17,2006. I can assure you that we are committed to assisting you; however we have been unable to locate the matter you have referenced from the information we have been provided. Please provide us with further identifying information such as your social security number, the creditor's account number and/or reference number and the billing address of the account. A copy of any correspondence you may have received from us would also be of assistance."

how do i get these people off my back??

Just want everyone to know that the last letter I sent that told NCO I was going to seek legal counsel worked!!!!!!!! I just received a letter from them saying that they will be deleting their tradeline from my credit report!!!
Thank you again for all the wonderful advice and a 'e-shoulder' to lean on!!

Linda,

You will need to get a lawyer in order to sue them, as there is too much involved to learn it all here, and if not done right they will win, and countersue you.

Keep in mind that NCO and FBCS are two totally separate entities. The offender here is NCO. NCO are junk debt buyers as well as debt collectors.

they sent me the exact same response again! i have proof that they are liars and cheats by reporting inaccurate info on my credit report ie, letters they have sent, return receipts from the post office and copies of the letters i have sent...what are the steps i need to take to begin sueing them???

I am in receipt of your correspondence request for addtional information. An account is being listed on my credit report by NCO financial which means you should have all of the requested information at your disposal without any assistance from me. In my initial communication you were provided with the account number you furnished to the credit bureaus. Therefore, I will not be forwarding any of the information requested by you. My records indicate that my inital validation request was signed for by an affilate of NCO. A validation period of 30 days was also extended at that time. Since you are unable to comply with federal law within the allocated time, please delete your inaccurate tradeline or I will not hesitate to seek legal counsel.


do you think i was too harsh? did it sound like i was threating?....what should i do now?

I live in South Carolina also. File complaints both with the FTC, Pennsylvania's AG and South Carolina's AG office. I received a reply back from NCO's attorneys via the PA AG's office that I was the one harrasing them. They denied every violation I referenced. Of course I was warned that this would happen. But the good thing is that the calls have stopped.

Send them a limited cease and desist (they can only contact you by mail). Or you can play games with them. Continue to take their calls and document every violation, and there will be many, then take them to court. You will win. The FDCPA is your friend. Read it, learn it, breathe it. State laws apply here as well.

I have successfully "dealt with" NCO Financial...Here's how..

Keep in mind that the AG's office has no real authority to do anything for you on an individual basis. They respond as a courtesy to you. The primary role of the AG's office is to represent other government agencies. They will go after an entity if there is a large number of consumer complaints, but that takes a while and still does nothing for you individually.

The FTC website is where you can file a complaint, and should do do on each violation. The FTC does not do individual enforcement either.

YOU must enforce your rights with firm written communication by certified mail, return reciept requested. Put the certified# on the letter itself and keep a copy for your records.

NCO has nothing to do with FBCS. FBCS is just the junk debt buyer who sold the "account" to NCO.

NEVER call any debt collector. NEVER!!! STAY OFF THE PHONE!! There is no reason to ever speak to a collector. It will never do anything positive for you and it will only make the calls more frequent. Think about something here..If they could actually do something..WHY would they need to talk to you? The answer is simple, they need to talk to you so they can trick you into re-affirming an otherwise uncollectable debt.

Upon first contact from NCO or any collector, you need to send the CEASE COMMUNICATIONS request by the means stated above. This will force them to do one of two things: 1. Go away as they know they cannot substantiate the collection effort. 2. They will file a lawsuit. This is what you want as now everything will be in writing and there will be no more phone calls.

Go to the FTC website and read and print out the FDCPA and the FCRA. Knowledge is power. There are also many good consumer advocate websites and bulletin boards etc.. like creditboards.com,budhibbs.com,complaints.com,bankrate.com and many more. Visit some of these sites and learn all about the junk debt buying and collections business.

NCO is the largest JUNK DEBT BUYER in the world. They buy these types of debts for far less than a penny on the dollar.

FYI...NCO Group just "sold" to Michael J Barrist who is the CEO of NCO. In reality it is just a name change as the law was on thier heels for illegal and unethical business practices.

Knowledge is power.

my husband has had problems with NCO in the past and they are rude and obnoxious. The best way to deal with them is to get on to the PA attorney generals office website @ www.attorneygeneral.gov and print out a consumer complaint form.

Send it to PA Attorney General with copies of everything NCO has sent to you along with copies of anything you sent NCO requesting validation of this debt and any other information requarding NCO.

My husband did this about a month and half ago and we have not received a bill and we no longer receive calls from NCO.

I hope this information can be helpful for you in resolving this issue with NCO, and what ever you do, do not send them any personal information.
