I'm not completely sure if my situation applies here or not but I don't know what else to try.

My husband and I recieved a new phone number in December of 2005. Since then we've been plagued with collection agencies looking to collect from the previous person with this number. We had around 4 or 5 different companies calling, all of them stopped within a month or so of discovering this number belonged to someone else.

Capital One. Capital One was calling our home constantly, in one day I'd traced over four calls from them with *57. On January 12th 2006 the Annoyance Call Center called Capital One and told them to stop, they also claimed to of sent this request in writing. Capitol One then gave our phone number to NCO Financial.

NCO has plagued my home since the start of March 2006. We've received a good deal of 05:30 wake up calls from them. Thankfully no calls past 20:00. NCO has lied about having my phone number in their system, threatened to have me jailed for interfering with their attempts to collect a debt, accused me of being too stupid to read a clock and has called me some pretty foul names to boot. Yet Brian, a manager/supervisor at NCO had no idea what state the area code being called was even in. Being in WA, NCO is THREE HOURS ahead of me!! No one will give me a full name or even their position with the company. When they stop yelling and threatening and I get a chance to ask for it I get hung up on. What a business like reply. All of this over a debt my husband and I are in NO WAY responsible for.

I have filed complaints with the FTC, WA AG's office, the PA AG's office, the Better Business Bureau and the Annoyance Call Center. I know at least ONE of these agencies has to of made it clear to NCO's employees that they're barking up the wrong tree. We've also started looking into legal action against the individuals calling as well as the NCO as a whole if possible.

As for the lies NCO managers and collectors have told about NOT having my number in their systems...
Yesterday I found a message on my answering machine from a Maxine Burman (not sure on the spelling). She asked for me by name this time. Supposedly she's with the Compliance Deptartment. I've tried calling her back but all I get is her voice mail.

In every complaint I've filed I've requested that NCO immediately stop calling my home as a desired out come.
Verification of traced calls is easily obtained. They're on the phone bills and show the dates and times these illegal and harassing calls came to my home. They also cost a buck fifty per trace.

I've read a few of the rebuttals by NCO employees on here... The attitude of these employees makes me physically sick, but it's what I'd expect from ALL NCO employees after dealing with those calling me. If I've ran on I'm sorry, it was not my intention to do so. However it should be interesting to see if anyone from NCO even makes an attempt to justify the company's illegal actions in this matter.

Just in case you did not notice I am in WA. NCO is in PA. Which means that 05:00 PST is NOT outside of calling hours for the EST time zone. There is a three hour difference. Each call was traced with my local annoyance call center so they AND my phone company AND every agency where I filed a compaint can see both the time the calls came to my phone and what time I activated the trace feature.


Second of all. The local police DO NOT handle threats of legal action and cursing via phone. Since there is no treat of bodily harm or property damage they will not get involved. I've called them and that is the response I was given, they told me to file complaints and civil law suits ect. How exactly are the local police going to do anything to these individuals? Obviously the idiots calling my home are well outside of the Ft. Lewis jurisdiction area. And so theres no confusion, I highly doubt the MP's would be anymore capable of taking action then the local police were.


If you find this so hard to swallow why bother responding? There are people on here who have been dealing with these morons longer than I have, and their stories are FAR worse. Unless you're an employee trying to save this company's facade. I see that you listed your rebuttal under "consumer response" if I worked for a company as immoral and illegal as NCO I wouldn't want to own up to it either.


I just want the calls to stop. If my filing a civil law suit helps others that are having false and grossly inflated reports put onto their credit then this headache was worth while to me.

I have had this experience with NCO also.

Look at the HUNDREDS of complaints on this site alone!

NCO has paid the largest fines in history for FDCPA violations!

AND, they DO call outside of legal hours.

You need a serious reality check.

Holly, you need to either file a lawsuit yourself or go to the attorney you spoke to and have it done. 150 miles is not too far to get this harassment to stop.

You have plenty of evidence, and will likely continue to collect it. You have the answering machine messages, it is very likely you can get the information from the Annoyance call center, and it would not suprise me if the telephone company could provide you with a log showing time and date of incoming calls and the number from which they originated.

The FDCPA was amended so if you sue you can only get $1000.00 per lawsuit and perhaps your filing fee back. If you use an attorney you can have him ask for your legal fees to be paid as well.
This is relatively simple to do in small claims court and in MANY instances the collection agency will simply offer to settle with you sending you a check to avoid having yet another judgement against them on public record. Even if they don't settle they are going to look awfully stupid to the court when you go in with all the records showing they have called you as early as 05:30 your time. That alone is a violation and they know it.

Don't let them get away with this. For all the annoyance they have caused you deserve to make some money from this.

okay, first off.. to the original poster, i would like to point out a few things that caught my attention, first off, NCO's dialer will not allow employee's to call a phone number if it is outside the calling hours set by the FDCPA. and second, and most important, if a rep is cursing at you, calling you names, threatening to have you arrested... why didnt you call the police right then and there? I'm sorry but i find your story a little hard to swallow.

I haven't had any experiences with the company you speak of but: In June of 1997, I acquired the phone number of an infamous businessman who had embezzled millions of dollars and cheated hundreds of people. Today, he's doing time in the federal pen but I had calls for 2 years straight looking for that bozo. I always explained to the morons that I, a different person, had acquired the number and they perhaps better engage better skip tracers. I also demanded they never call my house again. Before I said any of that though, I was exceedingly polite and ascertained as to where they were calling from. I then kept records. And, I did have to threaten and file a couple complaints with the phone company, but the calls eventually went (almost) away. Today, I receive about 1 call every 3 months and I just laugh and tell the caller they have the wrong number. My favorite call is when they ask for so and so businesman and I tell them they have the wrong number. Next, they ask if this is phone number XXX-XXX-XXXX and I reply that yes it is. Then they say, well do you live at XXX Main Street and I tell then that I do not, that while the phone company assigns phone numbers, they do not assign the actual residence that the previous owner had. "I got their phone number but I didn't get thir house, are you with me on this"? DUHR! The long pause and the "uhhh...Okkk" is priceless as you can tell these collection agency morons are struggling to process that bit of information.

Again, I know nothing about the agency you speak of but I am simply relating to you my own experiences with other companies.

NCO Group to Pay Largest FCRA Civil Penalty to Date

One of the nation's largest debt-collection firms will pay $1.5 million to settle Federal Trade Commission charges that it violated the Fair Credit Reporting Act (FCRA) by reporting inaccurate information about consumer accounts to credit bureaus. The civil penalty against Pennsylvania-based NCO Group, Inc. is the largest civil penalty ever obtained in a FCRA case.

According to the FTC's complaint, defendants NCO Group, Inc.; NCO Financial Systems, Inc.; and NCO Portfolio Management, Inc. violated Section 623(a)(5) of the FCRA. The law specifies that any entity that reports information to credit bureaus about a delinquent consumer account that has been placed for collection or written off must report the actual month and year the account first became delinquent. In turn, this date is used by the credit bureaus to measure the maximum seven-year reporting period the FCRA mandates. The provision helps ensure that outdated debts debts that are beyond this seven-year reporting period do not appear on a consumer's credit report. Violations of this provision of the FCRA are subject to civil penalties of $2,500 per violation.

The FTC charges that NCO reported accounts using later-than-actual delinquency dates. Reporting later-than-actual dates may cause negative information to remain in a consumer's credit file beyond the seven-year reporting period permitted by the FCRA for most information. When this occurs, consumers' credit scores may be lowered, possibly resulting in their rejection for credit or their having to pay a higher interest rate.

NCO is so bad, that in 2003, they have been sued 40 times for violations of the Fair Debt Collection Practices Act (FDCPA). These suits are usually filed when consumers are abused in violation of state and federal debt collection laws.

NCO is a money-mill, gobbling up competitors, buying portfolios of old debts for pennies, and expanding globally. These money-beggars are making their bottom-line profits at the expense and abuse of consumers.

One wonders how many lawsuits are NOT being filed because consumers do not know their rights or that NCO CAN be held accountable for their illegal debt collection practices.

Apparently, NCO is not spending enough time and money to properly train their debt collectors in accordance with law, the FDCPA. Do they hire any derelict that may be in-between court and treatment dates simply to harass, abuse, and oppress consumers? There is no mention of drug testing at their web site, so can you be hired at NCO if one has bad habits and a need for fast-cash. This must be a 'dream-job' for anyone with a prison record, drug habit, or any con artist out to defraud some fast money off unsuspecting consumers. Are you aware of the personal consumer information these money beggars have access to? I shudder to think how much information is being illegally used at agencies such as NCO. You should be VERY nervous about the type of individuals who have this unprecedented and open access to ALL of your personal information.

It may be just a matter of time until collectors start calling with accents from country's like India, Pakistan and ....(ooohhh my gawd!!)

NCO's CEO, Michael J. (kinky) Barrist seems to be astonishing Wall Street (NASDAQ:NCPM) with his financial wizardry. He certainly appears to be pumping up the bottom line. (One lawsuit at a time?) In my experience, this type of greed and consumer abuse will catch up with NCO, just as it did with Commercial Financial Systems (CFS) and Outsourcing Solutions Inc (OSI). Both operations were out of control just prior to their filing for bankruptcy protection. CFS's top brass is facing federal criminal charges in highly anticipated court proceedings scheduled for later this year.

If you are receiving abuse from NCO, contact me for referral to a local consumer law professional in your area. NCO, with $800+million in revenues last year, has more money than a South American drug cartel, so use the law to make them pay when they violate the laws and your consumer rights.

Do not let NCO's under-trained, uneducated and FDCPA lacking debt-collectors make a paycheck at your expense.
Big agencies pay big salaries to their ego-driven brass. NCO should spend a lot more time training their collectors and dealing with consumer complaints, in this case BIGGER does NOT mean BETTER! (Except for Kinky and his top brass team of money beggars)>>budhibbs.com.

First off I would like to say that until about 2 weeks ago I was a proud soldier of the 1st Stryker Brigade on Lewis, and have since PCS'd to Georgia. I recently got married and am trying to now fix my credit. But now my CR says that this horrific NCO MEDCLR collections Co. is saying I have 8 different debt amounts but half the dates are the same. I have never heard of this company and am not in debt to anyone. I haven't received a single phone I am lucky of that. However thats sort of the problem, I have tried and tried to find a way to contact this company a phone number, a name, an address, something. But nothing yet. I would greatly appreciate any information in contacting these people. And after reading all the stories I am really offended that there are actual people like this in our country. May God have mercy on them.

Holly, Similar Situation Here, But Beware!

Last fall I had NCO Financial calling here harrassing me about a debt that my father in law owed.

My father in law has never lived with my husband and I. But he gave my name and phone number, and also my adult daughter's name and phone number as references on a credit card application. Then he defaulted on the payments.

So, NCO called my home and my daughter's home and began harrassing us.

We both cent certified Cease & Desist letters along with filing a complaint with the Pennsylvania Attorney General.

Maxine Burman responded to the A.G. with the same lies, that our phone numbers and names were not in their system and that they had no record that anyone from NCO had ever called either of us.

This was a flat out lie as you too have now discovered that Maxine Burman is nothing but a liar.

Well, the phone calls did finally stop, BUT, all they did was sell the debt off to another bottom feeder debt collection company who started the harrassment all over again.

This time I gave them all the info that they wanted so they could contact my father in law and told them to leave me the hell alone.

Well, my father on law is now dead. He died 6 weeks ago. He was 69 and I am sure that the stress of being harrassed over this debt probably took as much of a toll on him as the illness as he was recovering from that. He just gave up the will to fight and live.

Holly, by no means believe that your harrassment is over. They pass these debts from one scum bag debt collector to the next.

It is a never ending cycle. When you get one to stop, they pass it on to the next, you get them to stop, they pass it on to someone else.

NCO; nothing but dead ends.

Since the BBB contacted NCO on April 10th the calls continue from something called a "Compliance Department". Now instead of asking for Michael they ask for me. On top of those we're STILL getting calls for the Michael guy too. NCO hasn't responded to the BBB on the complaint I filed. The BBB said that NCO responds to EVERY complaint filed with them just to maintain some appearance of legal collection practice. I've been instructed to get a copy of my credit report A.S.A.P. by the BBB, since NCO now has my name and address.
If theres anything related to NCO on it... all hell is really going to break loose.

The FTC has informed me that my complaint was put into a file containing complaints against NCO. That the FTC does contact these companies and that since this is not my debt there isn't a whole lot they can do. Apparently the FTC has to have so many complaints before they'll go after these sleeze balls again?

I've yet to hear anything at all from either the WA or PA Attorney General offices. Still waiting patiently.

I keep hearing that I should change my number. This wouldn't be such a bad idea if it wasn't for aging family members, scattered family and friends and the military to re-distribute a new number to. Besides in our area the phone company is so backed up they're only letting numbers sit dead for a few months.

Is there anyone else in WA dealing with these ignorant, arrogant, foul mouthed, threat happy, psychotics? If so I think maybe we all ought to plague the WA. Attorney Generals Office with daily complaints and inquiries until they do something to put an end to this. Maybe those of you that the FTC can help should plague them as often as possible along with your state AG.

For the last few days I've been calling various lawyers from the phone book. I broke down today and tried the legal assitance number here on base... They didn't know what to make of it nor could they suggest a lawyer to handle it. Another dead end. Anyone know of a lawyer around Ft. Lewis that might be able to handle this sort of thing?

One attorney from the NACA's listing said I had a very simple case against NCO. The only problem is that he's around 150 miles north of me and didn't know of a lawyer in my area off hand. He also advised me to get a copy of my credit report.

NCO Group to Pay Largest FCRA Civil Penalty to Date

One of the nation's largest debt-collection firms will pay $1.5 million to settle Federal Trade Commission charges that it violated the Fair Credit Reporting Act (FCRA) by reporting inaccurate information about consumer accounts to credit bureaus. The civil penalty against Pennsylvania-based NCO Group, Inc. is the largest civil penalty ever obtained in a FCRA case.

According to the FTC's complaint, defendants NCO Group, Inc.; NCO Financial Systems, Inc.; and NCO Portfolio Management, Inc. violated Section 623(a)(5) of the FCRA. The law specifies that any entity that reports information to credit bureaus about a delinquent consumer account that has been placed for collection or written off must report the actual month and year the account first became delinquent. In turn, this date is used by the credit bureaus to measure the maximum seven-year reporting period the FCRA mandates. The provision helps ensure that outdated debts debts that are beyond this seven-year reporting period do not appear on a consumer's credit report. Violations of this provision of the FCRA are subject to civil penalties of $2,500 per violation.

The FTC charges that NCO reported accounts using later-than-actual delinquency dates. Reporting later-than-actual dates may cause negative information to remain in a consumer's credit file beyond the seven-year reporting period permitted by the FCRA for most information. When this occurs, consumers' credit scores may be lowered, possibly resulting in their rejection for credit or their having to pay a higher interest rate.

NCO is so bad, that in 2003, they have been sued 40 times for violations of the Fair Debt Collection Practices Act (FDCPA). These suits are usually filed when consumers are abused in violation of state and federal debt collection laws.

NCO is a money-mill, gobbling up competitors, buying portfolios of old debts for pennies, and expanding globally. These money-beggars are making their bottom-line profits at the expense and abuse of consumers.

One wonders how many lawsuits are NOT being filed because consumers do not know their rights or that NCO CAN be held accountable for their illegal debt collection practices.

Apparently, NCO is not spending enough time and money to properly train their debt collectors in accordance with law, the FDCPA. Do they hire any derelict that may be in-between court and treatment dates simply to harass, abuse, and oppress consumers? There is no mention of drug testing at their web site, so can you be hired at NCO if one has bad habits and a need for fast-cash. This must be a 'dream-job' for anyone with a prison record, drug habit, or any con artist out to defraud some fast money off unsuspecting consumers. Are you aware of the personal consumer information these money beggars have access to? I shudder to think how much information is being illegally used at agencies such as NCO. You should be VERY nervous about the type of individuals who have this unprecedented and open access to ALL of your personal information.

It may be just a matter of time until collectors start calling with accents from country's like India, Pakistan and ....(ooohhh my gawd!!)
