In 2011,My company went into contract with New Vision Holdings,
LLC.  All business was conducted by Victor Pelt a.k.a Hardy Pelt who
presented as an enthusiastic man out to help the Christian population own their
own businesses, specifically a Dollar Store.  After finalizing our lease
in May 2012, we were led to believe by Mr. Pelt that our store would be
ready for open in July 2012. However, July came and went yet we received not
one delivery of fixtures and/or merchandise.  Finally in Aug. 2012 we
received our first delivery and others sporadically over the next several
months.
According to our contract, Mr. Pelt was to provide fixtures, a professional
buildout team, merchandise/inventory within a specified amount of money and
additional items for everyday dollar store operations. We have yet to receive our
full inventory, nor all everyday operational products. A buildout team came
twice but could not complete the project due to Mr. Pelts failure to order/deliver
all our merchandise. Despite it being his fault, Mr. Pelt voiced his refusal to
pay for the teams return and suggested we personally stock the store once he
sends more product. Mr. Pelt claims that he invested more money into our
store than we paid, as a result of us attaining a larger store than we
initially contracted for. First off, our larger store has nothing to do with
him upholding the contract, which seems to be his reasoning for default. Furthermore,
we are wondering where he accrued more costs when we received used fixtures,
priced significantly less than new ones and can be verified by the company from
which he ordered the fixtures. Also, our store is merely an approximate 400 sq
ft more of selling space, which suggests he paid less than what was to be paid
for our initial store size. Despite knowing that his claims have nothing to do
with our contract, we requested invoices to prove additional costs but have yet
to receive them.
Mr. Pelt did take some responsibility in Sept. 2012 for the store not being able to open and showed good faith by paying the first two months rent at the end of our rent grace period.  We thought this was noble and attempted to trust that he would deliver as he knew our backs were against the wall. Mr.
Pelt agreed to pay for Nov. 2012 rent if all merchandise was not delivered but never did. In Dec.2012, he attempted to lowball us with an offensive offer that did not even cover money owed from the contractual agreement.
