This is a followup to a previous complaint that had been closed by the BBB because the company lied and said they would give me a refund in 10 business days, and sent a screenshot of the email they sent me saying it would be refunded in 10 business days. 10 business days have passed and no refund nor any message about my return.
So I called and was told that I was not getting a refund "because the product was opened and damaged". There's no way it could have been damaged because I never used it. I opened the product to try and put on my trimmer because the item description said it would fit a Ryobi trimmer. It did not. But I find it very shady that they lied to me AND the BBB by saying I would get a refund within 10 business days, but when I called, I am told "oh you're not getting it back because it was returned opened and damaged." When they received the original complaint, they had already received the product and knew it arrived opened (I dispute it being damaged), so they lied. Now they are refusing the refund.
My original complaint is copied below.
I ordered a product from them, order #20143659, that their website claimed fit Ryobi weed trimmers. It did not fit my trimmer, nor did it contain any of the promised adapters that one can use to fit their specific trimmer. I contacted the company and got an RMA number, which was VZQ99HNS. I had to pay $22 for UPS to ship the item back to them.
According to tracking, 1zx2f8720342418474, it was received on June 6, 2022 and was signed for by Karina. So far I've received no refund. First I emailed them, with no response, and today I tried to call them twice. Both times, the automated voice said that all customer service representatives were too busy and I had to send an email or leave a voice mail.
I did leave a voice mail but because I got no response to my email, I'm not confident that they will return my call either. Convenient that they don't answer their phone.

So their story to the attorney general's office was that they asked me to take a picture of the item before shipping it, and I refused to take a picture of it. No they fing didn't. The original RMA request had the option to attach a photo.
At no time did they say it was mandatory as a condition of receiving a refund. If it was, then why in H did they approve the RMA request and said nothing about a picture being mandatory? They lie like rugs. And I'm still reporting all of their facebook ads to facebook as a scam company.

The BBB with all their BS is NOT the business police. The BBB is NOT part of ANY government or law enforcement body. The BBB with all their BS has absolutely, positively ZERO POWER to force or order any business to do anything.
The ONLY purpose of the BBB and all their BS is to SELL their PHONEY ratings and PHONEY accreditations to ANY business which wants to pay the price to BUY the BBB-BS and participate in the BBB con-game.

Update as of 7/14/2022: Thankfully, the credit card reversed the charge because I disputed the charge as "item not as described," and the website advertises a 30 day money back guarantee with no stipulations indicated.
I won't get the shipping back, but * you, Oak & Hearth. I've also reported you to the Orange County DA's office, the California Attorney General's office, and the FTC for selling items not as described and deceptive advertising. I'm also reporting ALL of your ads on FB as "misleading or scam," because you are a scam company.

Now their story is that they told me that I would get a refund in 10 business days, contingent on the condition of the item. But that is NOT what they said, and the screenshot of the email they sent me, that they themselves uploaded to the BBB, shows that is NOT what they said. They said that I would get a refund in 10 business days. So they caught themselves in their own lie.

Now they are saying that yes, they did tell me I would get a refund within 10 business days, but when they sent me that email, they didn't know it was opened and "damaged".
1. The tracking said they received the item a week before they sent that email, so how did they not know it was opened and "damaged"?
2. The website describes the item as "indestructible". It's solid metal; how could it have been damaged?
3. They claimed it was returned "opened" well of course it was opened. When I made the return request, I said that it did not fit my trimmer, as described on the website. How would it be "unopened" if I tried to install it and it didn't fit?
4. I have screenshots of the website description of the item, including claiming it's "indestructible". We'll see what the California Attorney General's office has to say about refusing to refund an item that was not as described.
