My wife and I sat through a timeshare presentation back in May of 2007. We were told it would take 60 to no longer than 90 minutes, plus we would receive complimentary tickets to a theme park. We just like everybody else were not interested, but they wouldn't give up. 



They are very aggressive and outright high pressure similar to a bad car dealership. I still have no idea how we were talked (duped) into buying this timeshare. Many things they told us ended up not being true, such as it's an investment, we could rent or sell at a later date for profit, etc... 


We did agree that this would force us to take vacations and that is a good thing, plus we were told that we could trade in our week in order to vacation in other areas including cruises. This of course is not the case and we just used our week for the first time due to us not being able to travel in 2008 because of the birth of our daughter. It was a nightmare from start to finish.



We arrived and our room/unit was a complete mess, worse than any hotel we've stayed in by far. It had no toilet paper, no towels, cob webs hung from the ceiling, smelled disgusting, vacuum wasn't even used, fire alarm pulled out from the wall (I'm sure that is against code), feminine products were in the bathroom trash. They apologized and switched our room only to find the same type of dump room, but this new one had vomit in the toilet.



Now you have to understand that if this was presented at the time of sale, we wouldn't have purchased. Who would! The unit they show at presentation is very nice including up to date furniture and even flat screen televisions. On top of the horrible state of the the room that you are given, there were no flat screen televisions and the furniture is out of date. Even the coffee table was incredibly wobbly at the point where it could have hurt our children if they would of played around, which they always do. I placed my feet on the coffee table to relax and it almost fell apart, so we were forced to move it.



I just hope to help anyone out there to not fall for the razzle dazzle like we and many people did. While our stay, there were many people with similar complaints and that showed me how bad this place really was. Plus you can get a room similar to ours from $50-$60 per night anytime of the year on sites such as expedia, pricline, hotwire, etc. I am currently seeking legal aid and speaking to the general manager/owner of the resort demanding a full refund. I know that payments will stop due to dispute and the fact that they misrepresented themselves, which is clearly fraud.

Breach of Contract

I am a victim of Oak Plantation Resort located, in Kissimmee Florida.
My husband and I also went through you and your wife described in the first three paragraphs of your situation.
Our situation is a breach of contract. Oak Plantation Resort showed my husband and me, a very modern unit when it was time to return for our vacation we were given something entirely different.

The money is already GONE!

Sadly, nearly all of these kinds of purchases are immediately sold to some sleeze-ball loan company at a discount.  Even  the loan companies usually wont buy the contract without a discount. They know there will likely be problems collecting.

This holds true for the buying clubs, vacuum cleaner door-to door $1200. and up machines sold on contract, many used car dealers, time share sellers, etc.  One of the few honest statements they may make is we cant give you a refund. Most probably, it isnt the seller to whom the money is owed. The seller has cashed in the contract, and the money is long gone. Naturally, the loan company has no desire or reason (or even any legal obligation) to negate a contract  which they bought and  paid. Of course the seller isnt making any refunds, as they are NOT in the business of BUYING whatever it was they sold, particularly at the price for which it was sold..

Oak Plantation is offering very little

Well, the General Manager Sharon Benton called back as promised. Unfortunately, she told us that getting out of the contract was not an option, as the lender would not allow it. She did apologize and told us they had problems with housekeeping/laundry and that someone highly recommended with experience was starting next week to oversee these problems. 


Sharon Benton also informed us that the developer was renovating the entire resort, but she didn't know when final renovations would be completed. She told us that there were units already upgraded, so the phase has already started. She offered a certificate for our family to stay a week at no charge next year in an upgraded unit, but availability would need to be open.

I then spoke to Maribell in the lender/collections department. This woman was a bit threatening because she told me there was no way we would obtain a refund and they are not simply just going to terminate the contract. She also told me that our credit would be in jeopardy if we refused to pay, this was after I explained that our credit is protected during a dispute investigation. She basically told me that I must grant Sharon Benton's offer to let them "make it right".

Now I'm a little offended for a few reasons. First, shouldn't we have received the "upgraded unit" during our stay, especially due to the fact that we were moved into 3 seperate units within our week? As far as the housekeeping/laundry issue, geez I would hope that someone with experience is hired. So does this mean that the previous person or staff had no or little experience. On top of all this there is an availabilty clause that comes with the certificate offer. Now keep in mind that we have already paid over $4K for our timeshare. I think a better offer would be some type of refund/adjustment for our recent stay.

Who's going to pay for all of the other expenses to travel back to the timeshare next year? The resort stay is the least expensive part, especially because you can find these units for $50-$60 online. We live in Michigan and it is very pricey to either travel by plane or car. Then there is food, entertainment, etc... I feel that they are offering this bogus certificate for many reasons. One, so they look good without actually doing good. This also keeps us quiet and in contract, which they ultimately want because we keep paying!!! Trust us, they want every little penny they can squeeze out.

I can assure that we our getting out of this contract one way or another and I will share with other victims once I find out how.
