We hired On Top Restoration and Construction, LLC, to repair and restore extensive storm damage to our home on Oct. 31,.2013. Contract was to be completed by Dec. 31, 2013. Days and weeks went by with no workers or only one worker present. Workers would loiter. Owner would not answer calls or reply. We closed contract in June and paid company, so we could go on vacation. Mr. McGrath promised to place screens on windows while we were away, but did not. As of Sept. 16, 2014, his company has not replaced the screens on four windows, although he has been paid in full. He will not answer our calls, and when we do reach him, he stalls and always has an excuse.

On Top Restoration was paid according to contract. They were paid on time for all additional work upon completion of the work. Other contractors were working on updates in the house that were not part of the storm damage that On Top was assigned, and they were not interfering nor near that area.

Whoever heard of a company repairing an entire damaged corner of a house including the windows and refusing to replace the screens to those windows that had screens in the first place?

Mr. McGrath would not answer nor return our phone calls. He made promises that he did not keep.

We do not recommend his company's services. That is the truth.

I can not deny most of your report, however, providing all of the information, will shed light on why the process panned out as it did. During the restoration process, we were informed that payments could not be made as insurance and the mortgage companies had not released payments. Thankfully, I had a VOI form signed by the homeowner allowing me to communicate with the Insurance and mortgage companies who claimed otherwise. Section 11 of our contract granted us the right to stop work if payments were not made per the contract. 

We were also asked to perform numerous jobs outside of the original restoration contract and were informed that the funds were in no way related to the funds the insurance company was distributing. Howeve, after said work was completed, we were informed that we must wait until the remaining funds were released from the insurance company. 

Additionally, I observed several other contrators on site performing additional work, again, outside of the insurance claim. After adding up nearly $16,000 in open invoices, it was in our best interest to postpone and/or delay work until our cash flow was sufficient to complete the job.

We did not invoice for the window screens nor were they part of our contract, therefor, we were not obligated to provide them.
