 On Dec. 22, 2014. I found a listing on criagslist.org for a house rental. I called and later that day met with Micheal Trotta, representing Suffolk Realty Group at the rental house at 28 midwood Ave. in Nesconset, NY.  We agreed on a lease for 12 months for 1800.00 plus all utilities starting Jan. 1, 2015. We agreed i could move in ealry becuase the house was vacant for no extra charge, Dec. 23, 2014. I met with the land lord on Dec. 27 and immediatly was bullied and shaken down for extra rent for my animals and the week we moved in earlier despite my arrangement with Micheal Trotta. I called Micheal and he smoothed out the weeks rent but could not talk the land lord out of an additional 50 dollars a month for my pets if not there would be no deal.  So i agreed to an additional $50 a month fee.  On Dec. 28 I spoke to the land lord and after a 45 minutes conversation telling me that he can go into my house when im not home with my wife and two kids are there without me there, stop by without notice, not fix anything that breaks because its my rental now, get rid of my cats or i have to leave, and much more.  After every statment he ended it with " if not theres no deal"  My kids are 1 and 2 respectively and my cats and i go back at least 14 years.  The realtor new i had cats and dogs this was a complete nightmare. I did not feel like we saw eye to eye and was fed up with his strong arm approach and said lets end our relationship now and he and i both agreed. I called the realtor and told him i moving out, you misrepresented me and the land lord, and that i wanted my realtor fee back in full.  He said "ill get it back when i move out."  We set a date and i agreed to pay the oil, electric, and per diam rate for our time there. I was as fair as a fustrated clent could be moving in the winter 2 times because the broker lied about the land lord policy on pets and privacy.  They took us to court so we could document our agreement.  We moved out as per our court agreement and paid for the time spent there.  But on the day we moved out Mike Trotta refused to refund the realtor fee. He reason is that he worked long and hard and spent alot of time with this(as in sueing me and lying.)  I explained the law to Mike that he had to or put something in writting that explains why im not getting it back or a statement of sort.  I was told to "F*** off"  I contacted the owner of his Company Patrick A. Curtis who claimed to understand the situation and was a mediator for many years.  He wanted to talk to mike again and his attorney before giving me my money back.  He dodged my calls for an entire week, multiple calls everyday, even up till now 2:02pm 2/19/2015 and three calls today he has not returned my call.  Micheal Trotta answers his phone but when he knows its me he hangs up.  I repetedly made attempts to to fax, email, and call.  They have a secratary that passes me to another employee who mocks me while the others laugh in the back round.  They are all jokes and have horrible manners i would be surprised if this company has had any real sucsess.  I want my money or an explaination as to what happened to it.  Patrick is a double talking sneak, desparate to make a buck that hides behind his secratary with strong arm messages about his attorney.  Micheal Trotta is a craiglist scammer, thief, lying POS that should not be allowed to do buisness in NY.  I will be filing a lawsuit against them today for the full amount but wanted to give everyone a heads up before doing buisness with this company or this realtor. The Truth About Richard Pollan & Erica Modiano

These two are liars, scammers and bull**** artists. They have no intentions of telling the truth about anyone or anything.

The sole truth in their statement is that 12/18/2014 they responded to an ad for a rental apartment in Nesconset @ $1800/month and met with my associate Michael Trotta, a licensed real estate agent who was acting with full faith and with the best interests of his client, the Landlord, at heart. The reader should first understand who this landlord is, that is such a miser and a bully according to the statement made by Richard Pollan. He is a 76 year old gentleman, retired builder, with some properties that he rents out to supplement his income. He is short, overweight and in need of support, not to be taken advantage of by tricksters like Mr. Pollan. Mr. Pollan was supplied with a lease by the agent Michael Trotta. He signed the lease and the lease indicated that Mr. Pollan had 1 dog in his household and that was the only pet. As an experienced real estate broker I can testify that landlords are sensitive about pets, and I have 2 dogs of my own. Landlords are sometimes afraid that pets can cause significant damage to a home due to urine & faeces damaging wood floors, fabrics, carpets etc and the smell generally associated with pets, and also the fact that their claws do damage floors and cabinets, doors etc. The fact that the landlord was willing to accept 1 dog at an additional rent of $50 monthly is extremely generous.So the total monthly rent due would be $1850, the total security $1850 and the broker fee due $1850. They also agreed to switch the electric into their name as part of the lease agreement.

So Sunday 12/21/2014 Mr. Pollan and Erica Modiano his girlfriend signed the lease, paid no rent, and provided a check from Gisele M. Burkavage, a 3rd party, not known to us, in the amount of $1500 in partial payment of the broker fee to Suffolk Realty.

12/23/2014 They bring a check for $1800 for the Landlord for the security deposit. The Landlord out of the goodness of his heart allowed them to have the keys so they could get the place ready prior to move in January 1st. They promised to pay him his rent  on January 2nd when he got paid, so the landlord arranged to meet them there to collect the rent January 3rd. They also promised to make up all monies by mid January from the next paycheck. They then moved in and with them 2 dogs and 4 cats. 

Sunday 12/28/2014 Sal the landlord is there with a helper to rake up the leaves, wants to have the place ready for their move in January 1st 2015.  He sees 2 dogs & 4 cats. The landlord has had issues with cats before so is very firm NO CATS.

Tuesday 12/30/2014 they come clean about the cats, it's hard to deny when they are there in plain sight, and they say they will move out then. Landlord says OK - just vacate and pay for yur electric use and they time you were there and leave the place clean and tidy as you found it. They also promised to pay for the oil heat they had used and to co-operate with the agent to show the place to other prospective tenants.

Wednesday 12/31/2014 Rich Pollan dodges communications & return calls with Michael Trotta about moving out and vacating the premises.

 1/1/2015 -  1/10/2015 difficult to communicate. many broken appointments & promises and still he is in possession of the home and still has not paid rent.

Monday 1/12/2015 - Eviction papers are filed in court. They are clearly not willing to move voluntarily. They have made no effort to vacate or pay rent, for electricity or oil and are clearly scamming the landlord.

Thursday 1/20/2015 - they are still in possession. They still have paid no rent. They went to court and Judge in his wisdom gave them until February 12th to vacate - so that's 1 1/2 months use & occupancy without paying a dime!

Saturday 2/14/2015 - Landlord attended the premises with a police officer from SCPD and changed the locks.  The tenants had left some furnishings behind so the Landlord could not re-let until the Sheriff has confirmed the tenants have vacated.

Tuesday 2/17/2015 - Sheriff posted a 72 hour notice to vacate.

Tuesday 3/17/2015 - Sheriff confirmed tenants have vacated.

So in summary The complainant in this matter has lied, cheated and posted false claims stating that he has been victimized when in fact he and his girlfriend has turned out to be true professional scam artists who have done this before and will probably continue to do so until somebody puts them in jail where they belong. He never paid a dime in rent, paid nothing for oil and electric, yet claims he is victimized. It would behoove the publishers of RipOffReport to verify information before posting their reports online.

We have and are willing to share back up information for all statements made in this rebuttal report.

 What a waste of an afternoon!!! This clown asked for a face-to-face talk to discuss him giving me my realtor fee back from one of his deals gone sour by one of his brokers (Mike Trotta).  My wife and two kids went to his office and after a 20min. wait in his office he came out only to walk circles around my wife.  With his double toungue he explained his case.  He didnt have one.  Nothing he said pertained to our situation and after 13 minutes with me on conference via my wifes cell he proved me that he is far from ethical.

The judge said despite the realtors lies and the home owners request to have us leave for having pets, ME and my family can stay there till Feb. 12 2015.  On January 8 the sewage backed up into the cracked pipes in the basement and in the bathubs, sinks, and toilets.  The toilet flushed and every drop land in the basement.  This was an unhealthy, unsafe, and disgusting living situation.  We are on record with the landlord and the property manager MIKE TROTTA of Suffolk Realty Group, who manages the property about this horrible situation we were living in.  Mike used this situation to get us out faster.  He refused to fix it, clean it, and his best answer was just move out i cant help you.  Only thing i could do is give you your realtor fee back when you leave.  The court order them to provide reasonable houseing till the 12th that was paid in full.  We lived with 4 inches of sewage in our basement, bathtubs and sinks filthy with back up. Mr. Curtis still stands behind the service and product they provided and insisted that he did his job and was entitled to the $1500.00. We cleaned it as much as possible but to no avail. Our property got damaged, we moved out early as a result of Michael Trotta's Managment.  After Mike lied to me, the landlord, and the judge, Mr. Curtis still believes he is entitled to keeping the realtor fee that was paid to Mike.   Patrick Curtis, boss and owner of Suffolk Realty Group who after dodgeing me for almost a month and with my wife infront of him NOW demanding answers. He needs now to go to the Court and see the transcripts for himself and that he will not be issueing a check to me today.  Dragging his legs with the same excuse i got 3 weeks ago.  He double talks himself. THIS MAN CAN'T MAKE AN ETHICAL DESCION ON HIS OWN MERITS, HE NEEDS A JUDGE TO TELL HIM WHAT TO DO. This guy is a clown.  Talk about a fool and a real class act.  Knowing he has no leagal leg to stand on he finished his meeting with me and my wife by saying "I have a whole team of lawyers and they all said i have a rock solid case you will get nothing from me, and your rants online are blackmale and will treated as such." SO WHY ASK ME TO COME IN AND WASTE MY TIME, REBUTAL ME ONLINE THEN I SAID??? My wife left and is currently heading to small claims court to sue this idoit for our loss and the damages we incurred as a result of doing buisness with this clown and his realtors.  I will post everything!!!!  I called him out to answer me on this forum and he declined.  I will post my Court Transcripts when this is done so you can see how ridiculose this guy is.  Lets clean up Long Island from slumlords and crooked thieves dressed as realtors, i hope my expierence helps in this process.
