Phil Bachman Toyota Allowed the purchase of a vehicle with a safety recall, and didn't fix it. Johnson City Tennessee

 I went to purchase a used vehicle from this company in December 2015. Upon receiving the car fax after I purchased the vehicle, I noticed two recalls presented on the report. The first recall listed had been resolved, but no record of the second. When I went to the dealership and spoke to my sales person, he told me that the outstanding recall had been fixed, but he was unable to show me the car fax to it. He then went and spoke to the senior mechanic on hand, and when he emerged he stated, "it is not a safety concern and that is why it had not been repaired. I legally could not sale you a vehicle win a safety concern." For whatever reason I did not pursue anything further, I accepted that response and left. Upon further research, admittedly later than I should have (2016), I find out that the recall is in fact a safety concern; but yet I was still allowed to purchase this vehicle, when legally I shouldn't have been allowed to. The recall in affect is due to a faulty rear axle pinion nut that can, more or less, come undone due to undersized pinion shaft splines. The resulting issues could cause the rear axle to seize, or cause the driveshaft to separate. Either incident would result in loss of motive function, and/or a crash without warning. I feel from a business standpoint and simply a moral standpoint, that this is unacceptable. To potentially risk the lives of the occupants of the vehicle, and other motorists around, is unethical to me. Safety is of the utmost importance when driving, especially when it comes to the safety of my children. I have called Johnson City Toyota and am currently waiting for a call back, though it has been roughly one week. I do not expect a call back at this point. Due to the allowance of me purchasing this vehicle, and the lack of concern in returning my phone call; I will no longer be giving my business to this dealership.
